Exemption or local planning rules - which has higher precedent?

    If your work is exempted based on the current rules, e.g. new windows are within exemptions limits but a local dev plan mentions a right to privacy regarding positioning of windows.

    e.g if you build a 2 story < 39 sq M extension, all windows are over the required distance from the boundary, but the local dev plan says the windows can't impact on privacy of neighbours.

    Do the dev plan guidelines now make the development not exempt or does the dev plan only refer to non exempt developments?

    If in doubt seek a Section V declaration from planning authority particularly if you think a neighbour could be troublesome.
