Claiming Social Welfare

    I'm being forced into leaving my job but I do not want to go down the legal route as I am too scared.

    Can I claim social welfare if it was my choice? I have never claimed before and have been working for the same company since i began to work 15 years ago.

    Any advice very much appreciated.

    1) However scared you are, don't be stupid. 15 years in the same job and you're going to walk out with nothing.

    2) Speak to someone at Citizen's Advice first before you do anything. If you as you say are being forced to leave you are doing yourself out of 2 years full salary if they are in the wrong.

    Please don't be hasty, talk to somebody first.


    You cannot get dole for 9 weeks if you walk out of a job in my opinion.

    The decision to disqualify your payment for up to nine weeks would be at the discretion of the deciding offer dealing with your claim, but it's best to prepare for the worst case scenario.

    However, to echo what another question said above, you should avoid leaving your job if you feel you are being pushed or harassed into doing so & a call or visit to Citizens's Advice would be worthwhile. In this day & age no-one should feel forced into resigning from their job. Fifteen years is a hell of a long time to have worked somewhere & I would advise you to think very carefully before acting in haste. There is help out there.

    Are you a member of a trade union? If so, speak to your rep.

    Have you any sort of company handbook that outlines the procedure for grievances? If so, have you followed it?

    I presume you are having problems with a manager/supervisor? If so, is there anyone at a higher level that you could speak to to about the matter?

    If you feel that you are being discriminated against for any of the following: gender, civil status, family status, age, race, religion, disability, sexual orientation, or membership of the Traveller community you could contact the Equality Authority http://equality.ie/en/About-Us/

    Quite a lot of solicitors specialising in employment law will speak to you by phone or arrange a consultation meeting free of charge, which might be of benefit to you, as they would be able to inform you of your rights which may give you more confidence in trying to resolve the matter at a local level. YOu could also contact FLAC http://www.flac.ie/

    As a start, & at the very least you should keep a record of all incidents that occur from this on in, which would help you in your jobseeker's claim should you decide to leave.

    If it is that bad you could consider leaving and then claim constructive dismissal

    It was so much easier to blame it on Them. It was bleakly depressing to think that They were Us. If it was Them, then nothing was anyone's fault. If it was us, what did that make Me? After all, I'm one of Us. I must be. I've certainly never thought of myself as one of Them. No one ever thinks of themselves as one of Them. We're always one of Us. It's Them that do the bad things.
