Paying for error that wasn't my fault.

    Good day,

    Last January my JSA payment was increased from 144 to 188. This happened just after my birthday so I attributed the increase to that, however I recently received a letter stating that I owe 1300 from the end of January to last week because I was on the wrong payment.

    This error was in no part of my own, I wasn't working during this period, nor did I make any false declarations, it was a error on the DSPs half. Do I have any grounds to refuse repayment or is there anything I can do about this?

    Not at all. Fair enough the mistake was made, but in any other scenario the money would have to be repaid. Remember when the ATM's had a glitch and started dishing out money that wasn't in peoples accounts? Do you think they let customers off? This is a human error, we all make them, but it has to be repaid I'm afraid.

    They could automatically deduct up to 15% of your weekly €144 payment which is €21.60 per week unless you agree a lesser amount with them.

    Talk to them and ask can they take €5 a week from you. If you get a job, in some cases they will write off any remaining money owed when closing the claim. Had a similar thing happen to me a few years ago. €5 deduction per week from an overpayment of a good few hundred. Got a job about 10 weeks later and when I asked about it, they just said not to worry.

    Roll on a year later and when that company went bust, I was expecting something when trying to go JSA but nothing was mentioned about it. It's a mistake that is easily made and even tho it's not your fault, you did receive the money so it will have to be repaid. €5 a week is a lot easier than €20 to pay back when unemployed.

    If you turned 25 on your last birthday your payment should have increased; if you didn't you will have to repay the overpayment. As previous posters have suggested you should go in the discuss you repayment options.
