How much notice do I have to give

    Hi,

    I am handing in my notice in work either today or tomorrow.

    I get paid weekly and as far as I thought the law was I would have to give one weeks notice however my contract states:

    Notice. This agreement will be terminated by the giving of 1 month’s prior notice in writing by either party or in the case of the directors at its discretion by one month’s salary in lieu of notice. Failing this, minimum notice as per the Terms of Employment Acts 1973 – 2001 will come into effect.

    Does the law supersede anything that is written in a contract?

    The law supersedes your contract only where they're in conflict.

    The law states the minimum notice to which you are entitled, not the minimum notice that you have to give.

    So if your contract states that either you or your employer are entitled to a larger notice period, it's not in conflict with the law.
