union recognition in one factory but not sister facotry

    I work for a company that has two sister factories. The factories share services and all the middle managers are over the same depts in each factory. For example the waarehouse dept manager is over the warehouses on both sites. This does not just happen at management level, there are a lot of non-management specialists over various aspects on both sites. On one site the union is recognised but on the second site the union is not. I recently joined the union and we are currently in dispute in regard to a pension issue. I work in the non-unionised factory and the company refuses to talk to myself or other union people over here. Seeing as we are essentially the same factory, can my company do this. What about those who work on both sites? Where can the union represent them? Your advice here would be most appreciated because we are about to go to the LRC and the company will not allow representatives from the non-union site be present.

    the employer cannot be forced to negotiate with the union in both factories. It's up to the employer to decide.
