Plans on a site

    Hi,

    I have been looking at a few sites over the last few weeks and all of them have architectural plans on them. Are these plans a suggestion or are they submitted with the planning permission and making changes to them, such as floor plans a change to the initial permission and therefore a resubmit is needed ?

    Or as the buyer, Am I buying the land with planning permission and as long as my plans are like the original it's not an issue. By like I mean following all the original stipulations, such as tile colour etc.

    Or are the floor plans fixed ? But the internals can be moved around as desired ?

    Permission is granted for a specific house and that is why it is necessary to submit detailed plans to see what exactly is proposed. You would be required to build strictly in accordance with the said plans.

    If you wanted to build a different house you would need to reapply for PP. If it was only a minor change you might be able to overcome this by requesting the change to be declared "de minimus" but not every planning authority operate such a policy.

    There is also the issue of copyright on the plans. Because you are buying the site will give no rights whatsoever to use the plans without the consent of the designer.

    Get your hands on a local technician/architect and they will keep you on the straight and narrow. :)

    My dad was an architect in the uk, I assume he could just redraw the plans? The plot advert has a good few plans attached.

    Who verifies what is built is a match to the plans.?

    he could do this, tweak the internal design, but your stuck with the external appearance and footprint unless as muffler outlines you revisit the planning permission. which if this is a rural site you may struggle to get

    your architect does. this is not the UK your dads experience will not help as regards planning and building compliance. as suggseted above you need a local architect to advise you on the current plans and lenght of time you have left on the permission to build - take nothing for granted from your auctioneer.
    you will then need a proviosnal DEAP assessment (SAP in the UK) and to review the planning file as regards site access & waste requirements perhaps others also.

    then ideally you'll need a detailed set of tender drawings at least checked by an irish architect and BER assessor.
    and ideally that same architect to help you through the construction phase signing off at several stages for your bank loan draw downs.

    i think you miss understood muffler, these plans are copyright to the architect, it may as simple as phone & follow on email from the the originator to you/your new architect.

    just to reiterate, there are new building control regs imminent, new h&s regs out recently and Building energy rating requirements that are difficult to achieve. you will need local help, but how bad you'll have you extra support/ watchdog in the form of your UK architect
