Was I right not to sell

    Hi All,

    I just wanted to consult the knowledgable people of the motoring Forum regarding the following situation.

    Have a car for sale on Done Deal. Get a few phone calls from a guy interested in buying it.

    He comes to see it we agree price.

    He then tell me he is in the motor trade and wants me to hand over the Log Book when he pays me. He offers no proof of being in the motor trade.

    I tell him that the only way I will sell to him is when I put his details on the change of ownership section in the logbook and I post it back to Shannon.

    He does not agree to this so I say fair enough then we have no sale.

    I know the transfer of ownership section in the logbook says that it does not have to be filled in when selling to a Motor Dealer......

    My question is how do you inform the Dept of Transport in Shannon that a car has been purchased by a Dealer? How do Car dealers do this?

    The Guy was not offering me any proof of him being a dealer or in the trade or telling me how ownership would be transfererd to him.... so as I said we did not complete the sale as I was not comfortable handing over the logbook under these conditions.

    Opinions and Comments welcome - Did I do the right thing or have I missed a sale?

    Regardless of whether he is in the trade or not when in doubt dont take a chance. By my reckoning you did the right thing.

    He came to you; it was a private sale. You were right not to hand over the log book.

    For some strange reason I sold a car recently(cheap I may add) and I just signed and dated the bottom and handed it over(Like a dumb ass). I was on donedeal the next day and seen the car up for sale at a higher price. He probably got the higher price too as I had four new tyres put on and timing belt done and everything.

    it is a flawed system but being over zealous you could lose out on sale.
    It would be better if there was a dealer section on forum so it covered you. Also many sellers see it as a choir to send in cert.

    Last few cars I bought seller offered me the cert after I signed it. I didn't say no :)

    Depending on the value of the deal I don't see a problem really. Money is money. So what if he is/isn't a dealer? Give him the signed reg cert, but just make sure you get him to sign some sort of a receipt/agreement, and get his personnel details if you can.

    In that situation I wouldn't sell either. As someone mentioned above, a good alternative if he really wanted it would be to go to his companies premises.

    It depends on whether the car is pre '93 or post '93.
    Either way you both fill in a form and you hand the log book/VLC to the Dealer and send the form off to shannon.
    If this particular buyer didn't offer this option then he is obviously a guy posing as a private seller (and not offering any sort of warranty etc.).
    He just didn't want an extra owner added to the car's history.
    The OP's main issue would be speed camera fines, M50 Toll bills and possible phone calls from the Guards about 'his' driving skills;)

    Pffft "In the trade"... Kerbside motors alright. There's a few lads that try this, they buy the car with the logbook and sell it straight on while its in your name. Their name never goes near shannon therefore doesn't raise any suspicion or gets the revenue involved..all while they make a handy few hundred on each car cash in hand.

    Not saying this was the case in your story but there are plenty of these chancers out there.

    You probably did miss out on a sale but your better of waiting for a genuine buyer to come along and have piece of mind.

    That was exactly my concern - speeding fines, parking fines etc arriving in the post because ownership would still be registered in my name. Imagine the hassle of having to get those sorted out.

    If he was actually a dealer then he would have a garage code and you could have filled out form RF105 which transfers ownership from your name into the garage name without adding an extra owner. In fact if he was any way properly set up at all he could have done the whole thing online and given you a printed receipt to say the car was now in his name.

    I reckon the other posters above are correct, he was likely a black market, part time, no warranty, cash only "dealer", not wanting an extra owner on the book, not wanting any paper trail potentially coming back to him. IMO you did the right thing.

    Dead right not to sell it. I can't see how rf100 can be filled without a garage code.

    You're probably selling it too cheap if a so called dealer thinks he can make a turn on it, advertise it dearer.
