assault in shopping complex

    hi guys recently i was assaulted in a shopping complex
    basically an individual known to me came up and headbutted me
    i immediately contacted security personnel
    and than went to my local garda barracks
    the gardai are investigating and are going to obtain cctv footage of the incident
    i didnt fight or strike out i grabbed his collar to restrain him
    and words were exchanged between me and him
    i didnt want to get into a fight because i was surrounded by women and children
    so i knew to keep my cool
    i am pursuing the case with the gardai and intend in pursuing a civil case also
    would i have grounds to pursue a civil case against the shopping complex because it happened on there property
    anybody been in a similiar situation
    i was 100% innocent basically i came out from doing groceries and the person was waiting for me to start a confrontation which he did as soon as i got within his range so to speak

    What is the basis on which a premises owner in that situation would be liable?

    I'm sure you don't suggest that a commercial enterprise should be able to predict random, unprovoked assaults on their premises?

    If you have the wherewithal to know you should be going after the "deep pockets" you have the wherewithal to know you should be asking a solicitor that question.

    How are they in any way responsible? IF you legally could make a case, Why would you pursue this out of any other reason than greed? You realize by doing this you're just showing yourself to be greedy and about as fair/civil as the guy who hit you?

    Have to agree with most of the comments here, you have no right to any claim against the shopping center. You are just being plain greedy!!! :mad:

    well as any business they have got to show due care towards staff aswell as customers..
    if they had a good security presence in place than i feel i would not have been assaulted
    granted they cant be responsible for the actions of a nutter
    but as said if security had been present in the mall/store where the incident took place it may not have occurred
    as for the comments of being greedy f off
    i was just another normal person doing my groceries and was subjected to an unprovoked attack
    i did not do anything to cause the altercation or in any way provoke the individual

    You said you knew the guy who did it, you have prior interaction with him. There's a story you're not telling us.
