Backed up traffic - undertake or overtake?

    Occasionally I find myself cycling home via this one-way road in Galway city. In the evening the left lane is backed up and the traffic is either stationary or moving very slowly. The right lane is now right-turn only and is fast-moving.

    According to the ROTR am I allowed to move up the line of traffic along the left? There's generally space to do so.

    Or am I meant to overtake on the right, which would be pulling out into fast-moving traffic.

    I'd generally carefully make my way up on the left, but there was a Garda car in the build-up yesterday so got me wondering... :o

    Yes. Or rather, according to the actual law (since October 2012 IIRC) you are allowed to pass on the right or the left, unless you are passing on the left of left-turning traffic (which is obviously a very bad idea).

    It was a grey area up until October last year since overtaking slow traffic queues on the left has always been legal, but whether this was legal to do within the same lane, was unclear.

    As Lumen says, since October it's been expressly legal for cyclists to overtake slower vehicles on the left, unless that vehicle is turning left up ahead. Lots of people obviously though aren't aware of this because I still have loads of left-turning drivers waiting for me to overtake before turning, and likewise I see lots of cyclists overtaking left-turning vehicles on the left at junctions.

    (b) A pedal cyclist may overtake on the left where vehicles to the pedal cyclist’s right are stationary or are moving more slowly than the overtaking pedal cycle, except where the vehicle to be overtaken—
    (i) has signalled an intention to turn to the left and there is a reasonable expectation that the vehicle in which the driver has signalled an intention to turn to the left will execute a movement to the left before the cycle overtakes the vehicle,

    (ii) is stationary for the purposes of permitting a passenger or passengers to alight or board the vehicle, or

    (iii) is stationary for the purposes of loading or unloading.”,
