Eurieka.ie "Order not accepted due to price error"??

    I placed an order for a laptop and a bag on Eurieka. Within five minutes they emailed me saying my order hasn't been accepted due to a pricing error and then laptop disappeared off the website. After a few email exchanges which included an attachment of my order confirmation stating the prices, I was repeatedly told that their simply not accepting my offer? The money has been taken out of my account though, which they tell me is the banks problem.

    Is this right??

    How big is the difference between the stated price and what they claim to be the price?

    This is an oddity of an issue as you have both Irish consumer law and the EU Ecommerce Directive in play. My memory is that the Ecommerce directive includes retailer protections for obvious* pricing errors and a get-out for the credit card payment being deemed to be acceptance of the offer but that it needs to be stated as such in the T&Cs. However its been a while since I read the legislation and I also don't know if we've transposed the lot yet.

    *An obvious pricing error would be along the lines of a 999 euro laptop for 99; but not at 799.

    It's a samsung 3 series NP370R5E-A06, the price was 390euros before tax, so came to 480 all together. I asked them what exactly was the 'error' and they never answered that. Just kept telling my offer is refused. The laptop was removed from the site immediately and still no sign of it. I've actually found the same laptop since for 420euros (incl tax) on another site, however i'm extremely short on cash now.

    In this case if you can get it cheaper elsewhere, you really just want them to give you your cash back. Hound them tomorrow about it - its not "the bank" that took the money, they processed the payment and they should be able to refund it immediately.

    Just sent an email to the second company (elara.ie) , asking them to confirm the price on that model. And guess what?? I got no reply; but the laptop has disappeared off their site now too lol????
