Err, I was there at 'the suit co' earlier today, and there were stairs going down to the basement and they had rather dingy area full of various 70% off stuff including jeans etc, not a lot of choice though. Picked up a pair of Tommy Hilfiger jeans for 30 euro and some other brand for €24, there were a few Levis 507s for €30 etc. While paying for stuff a big sign says 'no exchanges or refunds'. Over all experience = suspicious.

No refunds/exchanges is standard practice for most shops selling damaged/faulty goods.

That sign is illegal, Clerys should know better that you have statutory rights

Has anyone ever actually seen a pair of Levi's selling for 125 euro? Would have thought 60-70 is more like it.

As far as I know if you are told at the time of buying that there's a problem with it and you're willing to pay the price you've no comeback.

    You have STATUTORY RIGHTS !

They can of course give you a credit note, but if the goods are not of merchantable quality, not fit for purpose etc etc etc then..........

    Anyway back on topic

Where in the shop is this place? is it sign posted or is it just everything in men's?

I'd have thought that upon buying the clothes and I was informed they were flood damaged that I'd have no comeback for say a stain or a smell being in them.

If there was a fault as a result of a manufacturing error say the Seams come apart after two weeks then I could see the case alright.

If its the first scenario I couldn't see any comeback. If its the second then I could.
So yeah the sign would be wrong in the latter case?

  • Registered Users, Registered Users 2 Posts: 6,430 ✭✭✭positron

They didn't mention any flood damage or anything, just the usual 70% off signs. And there was no mention of 'no returns / refunds' clause either, so you basically end up spending so much of your time picking and then at the till you see this sign and then your choice is to buy it or walk away and waste the time you took to find the right sh1t among all the other stuff. So I suppose they are less than reputable operating with a policy like that, but then again I am sure you would still have your statutory rights like vicwatson mentioned at the top of the page.

Saltyjack, The suit co is not part of Clearys as far as I can tell. And the downstairs section of the OConnel St has it's own till and doesnt' appear to be part of the suit co. either... So yeah.. I don't know. Items I picked up seems absolutely fine though - not damaged in anyway.

The thing is they could always just say they are not taking and that's it. Really what are you left to do over something that cost 20 or 30 euro.

    Heading in to this tomorrow.

Downstairs there is a giant sign at the till saying there are absolutely no returns or exchanges.

  • Registered Users, Registered Users 2 Posts: 6,430 ✭✭✭positron

At the till right? Is there a sign else where stating that, if so I missed it.

That's the thing with sales in Ireland. You have to ask yourself are you actually getting a deal!

If that was Woodbury Common, the place in the countryside outside New York that Kildare Village is based on, you would be looking at $50 each, buy 2 get 1 free. Basically 3 pairs for less than they charged for 1.

I know it's in a different country but I couldn't bring myself to pay that much for a pair of Levi's knowing that.

Was funny because they said if i bought a belt with the discounts i would only pay €3 for it. I got a belt worth €29 and the total bill came to €88:confused: It seems they add up the discounts and instead of getting them per item they gave me a bulk discount so jeans cost less than they should have and i got €29 belt for free:D

No its not if you have pointed out that the product could be faulty - "sold as seen".

It one of the only reasons a sign like that can be displayed. - Liquidation sales by an officially appointed liquidator is another that can use the same signage.

the goods aren't being pointed out as faulty. They are simply saying they are not taking refunds. Also it is not a liquidator's sale.

Is it all jeans or is there any suits for sale?

Jeans, shirts, tshirts, jackets, slacks, also 70% off suits upstairs although am not sure if they are part of the same Clerys stock. As to people saying oh that sign is illegal blah blah blah....yes i know i have statutory rights as a consumer. When i went to the till the guy asked me if i wished to try the clothes on as there will be no refunds or returns, I tried them n and they fit fine. I got €200 worth of designer clothes for €54 so i don't really care if they have a sign saying shoplifters will be shot:rolleyes:

What if they fall apart first time they get wet out and about? Or if they cause a skin rash which turns complicated and requires urgent leg amputation?

Only joking. I have nothing against their policy, but they should, perhaps out of decency, add something like "this does not effect your statutory rights" or something like that.. just to be nice and proper.

Great post op. Just in there and bought 2 pairs of wranglers and a pair of levi's for €70! Full rrp total was €235! Very happy.

Tipped in yesterday and cleaned up. Had to go back today. Stock is diminishing in blanch rather quickly. Shirts are selling as are jeans.

    No problem people.

  • Registered Users, Registered Users 2 Posts: 5,063 ✭✭✭Greenmachine

Saw a few other shops around the henry street area in Dublin CC also selling "Flood damaged stocked".

I would say if it is being sold as flood damaged, then it is sold as seen. The reason for the discount has been clearly stated.

Would the insurance on Cleary's not cover the loss?

If it was covered by their insurance. The stock becomes property of the insurance company, who can then dispose of it as they see fit.

There is its basic consumer law provided for under the Sale of Goods and Supply of services act. If the goods are marked as damaged etc, then you cant return them on the grounds of that damage but according to the posts thats not what the sign says.

    try reading the post!

I said an official liquidators sale is ANOTHER format that does not have to operate a refund policy - in no way does the post suggest that this is/was a liquidation sale.
