Child Benefit , Matenity leave in another country

    Hi All

    My son is born 5 months ago in Poland , my girlfriend was working in Poland and she is currently on maternity leave in Poland , They have recently moved to Ireland to live with me and we are applying for child benefit.

    She is not getting child benefit in Poland but she gets her salary , I have to say her salary is very low.

    We are now filling the child benefit form and they ask if my gf is working , do you think our child benefit application can be declined because she is on maternity leave in Poland ? They have permanently moved to Ireland to live with me and we are not married and I am taking care of my girl friend and my son. I am employed since the day I arrived to Ireland.

    I am really worried that our child benefit application will be declined because she is on a maternity leave in Poland, Her salary is really low comparing to Ireland and I am paying alone all the costs rent,his nappies, gps...etc !

    Please help on that. :confused:

    I don't know whether you week get a yes or no, but I can tell you that a one parent is from out side the country the application process will be longer and there is a further form to full out about habitual residence.

    Also if you do get it, you will get a form to fill out bite and then to prove you are still working in this county.

    EU/EEA citizens and Swiss nationals working in Ireland satisfy the habitual residence condition for Child Benefit. This is also the case if the worker becomes unemployed and gets Jobseeker's Benefit.

    If you are an EU/EEA citizen or a Swiss national and work in a country covered by EU Regulations, the country you work in usually pays Child Benefit even if your family is living in another country. However, if your children are living in another EU/EEA country you should still apply for any Family Benefits you are entitled to there.

    AFAIK child benefit is paid based upon having enough contributions in Ireland or another EU country. Only one parent can get it though, so either you or your GF. I would recommend you apply as it will be easier for them to check your contributions than hers. Child benefit is not means tested so her or your salary shouldn't come into it. More likely they to want to ensure that she is actually living here and not over in Poland. I would suggest that you apply only in your name, and not hers. That way her working is irrelevant. Once your wife officially leaves work and is no longer in receipt of any wages or maternity benefits, you can transfer the benefit to her if you wish.

    But my experience of child benefit is limited, so I would recommend perhaps speaking with citizens information first to ensure that you are applying correctly.
