Fake Business

    Ok i am looking for some advice.

    I am a stay at home dad while my partner works. i claim nothing on social welfare and survive on her income. I have some knowledge about computers and phones and time to time i have taken on a few odd jobs just to keep our head above water with bills. Recently i have set up a facebook page offering my services and have gotten in a job a day which has been great and we talked about registering as a company.
    All the people i have done work for have i think assumed i was a proper company, not through me saying it but with how i conduct myself.
    Anyway i recently did a job and it went south and offered to pay the repair bill if they bring it to another repair center but this is not good enough for them and have asked for my company number and said they would be in touch with the consumer agency. Now i believe they are just blowing smoke at me and will fade away but it has got me thinking about what can be done to me legally if something like this happens again. I have closed the page down and am not accepting any work again until i know for sure what can be done to me if i am "working" and not registered.

    If you're claiming nothing on social welfare, as far as they're concerned, they couldn't give a flying fcuk what you do in your spare time.

    Right now you are not insured so you're exposed to unlimited liability, but chances are a civil case brought against you would only judge you liable for the cost of replacement of the device.

    To prevent against this type of liability in the future you'd be best to register yourself as a business with the CRO and take out personal liability insurance (mine only costs €230pa and I'm covered up to a maximum of €130k as a self employed IT Consultant), that way you're in a much stronger position legally speaking, and you don't have to worry so much about this sort of thing happening.

    That person could well be blowing smoke up your tailpipe, but you've left yourself open to it by not protecting yourself.

    Op, I doubt that they'll chase you. They're trying it on. They should have known from your ad that you were doing it for pin money.

    Most small companies start off like this . If the revenue come knocking on your door just say you were doing it as a hobby and covering costs only ......

    No tax liability ,

    If the company reg agency come knocking on your door just say you are not and have never been a company and send them packing ......

    Nobody was hurt so no insurance issue ......

    You have already offered to pay to have the issue put right .......
    Any judge would see this as putting things right

    Make sure you email all conversations so you have a paper trail if it ever did go to court .

    why not register? ..If you're not making much you won't be liable to tax really(part from the Univarsal tax they've brought in) Currently registering myself, you also get some other benefits if you're "self-employed", putting electricity towards costs for example.

    It's worth looking at.

    There is no requirement to actually set up a company in the Ops situation. He can register for tax in his own name or register a trade name and operate under that. A trade name is just that and is not a company.
    You are not required to register for VAT either with a very small turnover.
    It is therefore very easy to be legit. I would strongly advice that you look at all the welfare implications related to registering as self employed like this because the system is F*cked up here and you may well be making it more difficult to get anything from welfare in future by setting up as self employed.
    If while unregistered you were silly enough to invoice with vat charged, you could be in big trouble with revenue.
