Maintance payments when on social welfare

    I was just wondering if anybody knows what maintenance you are required legally to give when you are in receipt of job seekers allowance of 188 euro a week I have been away working for the past two years but now I'm home and looking for work I can't keep up the current payments I simply can't afford it I have 1 child .. Also the mother of my child has recently informed me she decided to tell the social a few months back I wasn't paying maintenance so she could get more money even tho I was I'm just wondering if this could have any legal implications on me could I be taken to court over this .. Any information would b greatly appreciated ... Thanks in advance

    Have you been actually been making maintenance payments since you's split,

    Has she taken any court action against you,

    If you have been paying maintenance and she hasn't informed social welfare she could be in a little trouble

    As far as I know, the only way you can be taken to court over this is if SHE takes you to court. If she is telling social welfare that you are not paying anything, then she will be getting a little more from them. Probably not much but a little more.

    I don't know how much you are paying at the moment. But my sons dad paid €30 a week when out of work, and €40 when he got a job. Its not much, but its regular, and to me that's what matters. (he also goes 50/50 when it comes to big things like Santa presents, birthday parties and back to school)

    I don't think the court has a 'set' amount that they would recommend, because the mothers income and the child s costs are all taken into consideration ( if the child had medical costs etc) and every case is different.

    Maintance payments are decided by the courts.
