Drive off at topaz scam ??

    So I just got a call from Garda or so they say, saying that I haven't paid for gas at 16/6/13 with "insert license plate" he told me it was 20 euro and that I need to pay it otherwise I'm going to get arrested ? O.o Now first of all I always and I mean always pay for my gas never have I once forgotten about it, so to get this call at this hour over a month from that date stating that I have to go back and pay it is well very scam like sounding to me or atleast a **** up on someone's side. Now the guy said that I have to go to the topaz give the date and tell his name then give in 20 euro and I will get a receipt some use that is to me since I've paid already... What I want to know is do I have any rights to look over their tapes and see their proof of me driving away without paying ? Logically speaking I should shouldnt I ?

    How do you know it was a guard who rang you :confused:

    Do you actually know it was a guard?

    If they ring back again (which is doubtful!) tell them you'll call in to the station to discuss it in person.

    Absolutely do not pay anything like that over the phone by credit / debit card.
    The Gardai would definitely not ask for payment for something like that by phone and do not ring the garage (or a number given) and pay that way either.

    Call your local Garda station (phone numbers here : http://www.garda.ie/stations/default.aspx )
    Ask to speak to someone and explain what's happened and ask if this is really them.

    It could be someone driving on false plates.

    Nobody else has borrowed your car or anything?

    If it is someone winding you up, it's a criminal offense to impersonate a Garda in that kind of way.

    I didnt pay for gas either. Lifted a yellow cylinder into the boot and drove off.

    Guards have everyone's phone number.. they can get it from your tyre tracks.

    My friend did this before, genuinely forgot to pay for his petrol as he had got a few other things in the shop, the cops called to his door about 3 days later and reminded him to pay next time he was passing....

    Check the number that they called you, if its the gardai then ask to see some evidence. Otherwise tell them there is someone with this number impersonating them.

    I'd definitely ring the Gardai and see what they have to say.

    You would definitely be entitled to be shown evidence that you didn't pay!

    The Gardas deal with this pretty much ASAP. I can't see why they sat on their arse rather than deal with it at times. Other than if the CCTV is recorded on to a hard drive. The video of you at the till paying has been recorded over. Meaning there is only a picture of you driving away. Tell the gardas you want to see the CCTV evidence otherwise your not paying

    It's also possible that the garage has somehow mistaken who drove off or not registered your payment somehow.

    You could demand to see the video from the shop around the same few minutes which should show you paying.

    If you paid by card, just get your card statement and show it.
    If you ring the bank, the should be able to give you a time and date of the transaction too.

    A guard calling you at midnight, looking for you to pay for somthing from the 16th June.

    How did they get your number ? Seems odd to say the least.

    When I worked in a petrol station years ago this was standard. If we had petrol filled but unaccounted for we had to check the tapes. If they confirmed somebody driving off without paying then we reported it to the gards. They usually came and took a look at the tapes to confirm and then contacted the person asking them to come in and pay.

    Did you pre pay? It sometimes leads to confusion as the fuel usually can't be cleared as paid til after it's filled. Sometimes the person behind the counter puts the money in the till and forgets, but normally you can spot that on camera.

    Well that's the thing he stated my cars make as well, I'm definitely going to call the Garda station tomorrow though. He told me I need to get there told me the guy who will be working there and that I need to give him the money so to me it sounds sorta like the guy who is working there might be scamming people, so yeah.

    If I knock off a bank in Ireland, will the cops just ask me to pop in and return the cash?....top system.

    I'm going to presume that, given it's 20 euro or so worth of petrol, that there is a benefit of the doubt that the person isn't a serial petrol thief and only did it out of desperation due to being broke, why else would someone use their own plates to do it.

    From experience the only time a garda will follow up on an alleged drive off is after they have seen footage proving that you have indeed driven off without paying. You would be surprised how often it happens people can get distracted & genuinely leave without paying unfortunately for operators there only means of seeking payment is too contact the Gardai.

    It is unusual that the Gardai has left it a full month to contact you. Most operators will have contacted the Gardai shortly after the incident took place so ideally you should have been contacted within a few days.

    You have the right to review footage. Make sure you request the data from operator in writing within a period of four weeks however if its an alleged drive off this footage should have been downloaded & given to the Gardai & noted by the operator. If you feel that you wish to dispute this then contact your local Gardai station so that they can review & confirm it is indeed the right person they have.

    I would request information such as CCTV footage of you entering the forecourt, filling fuel & leaving forecourt without entering into the store! If you have entered the store & perhaps got distracted let them prove that you haven't handed over cash/credit card etc if you had entered the store it is likely your intention was to pay thus harder to prove etc Good luck
