    Lets assume that the BMW is parked with the corner of its nose sticking out, who is at fault here?

    Bad parking or should the Luas driver halted.

    While I had to admit it because that is asshole parking of the highest level, I think the Luas driver should have stopped if he had any inclination that he couldn't pass it. Seems to have pushed it up into the street sign so gave it a fair old whack...

    Might be 50/50 though...

    EDIT: Can now see that the car was leaving a side street and not parked

    I don't think the BMW is parked, he came out of a side road infront of the Luas and the Luas drove it into the sign, there's better pics out there.

    Well if a car hit the parked car,the car that hit it would be at fault.But since a luas cannot divert its path id probably go with the parked car being at fault.Its illegal to park on a luas line anyway.

    However the luas might be classed as being negligent for failing to stop for the car.

    Its fairly grey.

    The comments on broadsheet seem to suggest that near-misses are a common occurrence at this spot so if anyone, the council are probably to blame.

    The Luas weighs 70 ton plus passengers, momentum....try stop that in a hurry.

    If the BMW was parked on a normal rail line crossing and got hit who would be to blame? It's a light rail/tram system in the city. The car either parked stupidly or pulled out to try get in front stupidly. I can't see the LUAS speeding up to cut off a car in all fairness.

    How are the council to blame? The LUAS is signposted clearly enough everywhere at junction. It's a D reg car so know what a LUAS looks like from experience, either as a driver or pedestrian, probably knows without signs the LUAS line is there and took a stupid chance.

    Anyway, who knows...the drive could have had a heart attack, a fit and hit the accelerator. Nobody knows what happened really.

    From the image posted of the other end, I would put money on the car driver at fault, possibly gone through on a red light. At least there's no injuries!

    from my knowledge of Cars and trams ...the car driver is more than likely at fault, there is a slight chance that the LUAS driver didn't have permission to go straight on - but on the balance of probabilities the car ran through the lights.

    its the start of the luas so luas had only just entered the junction.

    I would be 99% sure that the BMW driver came up to the junction too fast, stopped with his nose sticking out and the Luas had no way of stopping in time.

    1/. It was possibly caused by a rogue passenger on the Luas.
    2/. Black is infact white.

    Other than a tram going through a red light I cant see how it could ever be at fault in a crash. The thing is on a track and cant deviate. Idiots that keep crashing in to it are completely at fault imo

    I'd be looking for skid marks. I'd say that feckin' Luas driver didn't even try to swerve out of the way!!!

    I've never seen any trams in Mayo - but who knows - maybe they exist.

    I agree BMW GmbH have been putting crap brakes on their cars for years - and then marketing to the Wrong Kind of People.:D
