Ebay problem

I bought an item on ebay which turned out to be unfit for purpose.
Buyer protection did not cover me as the problem arose only after the 45 day period. Ebay arranged with the seller to offer me a partial refund-I would pay the postage for return of the article to the manufacturer, and gave the seller 3 days to complete the transaction. I received a message from ebay asking me to inform them if the refund had not been made by the specified date.
No money was paid, so I informed ebay by using the escalation procedure.
I then received a message from the seller saying ebay told him he was not liable to refund me anything,as I had escalated the case, and he cheekily thanked me!
Ebay now say the case is closed. I am out of pocket £150 and don't even have my faulty equipment. Contact with ebay by phone is impossible and the online help chat function is limited.
    Any suggestions?

Was it a private seller or a business? Where is the seller located?

What was it, and how did it take so long to discover it was not 'fit for purpose' ?

So it looks like you have sent the faulty item back to China . -

You have no protection after the 45 days and should have raised a claim before-hand .

Ring eBay on freefone 1800948010 - it is possible to talk to them .

You will have serious difficulty tracing the item back to seller through communication , but you should be able to track it successfully .

It was a wildlife cam. I didn't use it for a couple of weeks, then set it up and it worked superbly in dry weather, but once the rain came it filled with water. This was about 8 weeks after the purchase. When I contacted the seller they said it should be covered in rain.....even though the specs are that it is waterproof. I do have another model I got from another buyer last year which is waterproof- this one had an email function which is why I chose the model-extremely sharp pictures.
I will say that in dry conditions it worked amazingly well-really impressed by photo/video quality, and email function worked. I tried sealing it but it just didn't solve the problem.

Resolved- money sent back to PayPal.
    How?
Threatened them with HM Revenue and Customs, Office of Fair Trade, and Police Anti Fraud Unit.
Now must close my ebay account.
