    Hi there can I ask for some advice from people that may know please and thank in advance for any replies.
    So a long story short, my pal who was on DA had his payment stopped at the end of May this year, he was getting paid for him, his 4 girls and his partner, his partner works part time and his payment was reduced accordingly, they sent him out letters, means tested him again and gave him letters for his GP to fill out, he sent everything off and was told his payment was been stopped so he contacted the department and they re sent him all the exact letters to fill in again and get another form filled out by his GP, I seen this form filled out anf it made my mate sound really ill and I even asked was he alright.

    After a week or so the letter came from the department saying his payment is been stopped as he is fit for work, now I can assure you he is not, he can not even walk a few hundred meters without stopping and sweating like a pig, he just let it go and did not appeal and its now too late to appeal and he has been sent down to the dole office to sign on for jobseekers allowance, obviously he had to say he is fit for work (but he's not)

    Not only is his family down over €600 a month over this as his DA allows for part time work (JA doesn't allow this) etc, he's also depressed to bits over it and cant' really work, now to the point of my post.....He qualified for the DA on one single ground ( I can't go into detail) but he could also qualify on at least 3 or 4 other grounds so could he re apply using one of those other qualifying conditions? He is prepared to put up a fight for this as he can not work. BTW he is getting a small payment from the CWO at the minute until his JA is sorted out.

    He can always re apply yes but he will lose his JA once he opens a new DA claim/application. And there's no guarantee he will be awarded the payment even with new evidence etc. If he had appealed the DA decision he would have continued receiving JA with the seeking work condition waivered- not that this helps you now though.

    Thanks Tasden for your helpful reply, so if he does re apply for the DA he is then not qualified for the JA, that kinda makes sense but could he go back to the CWO then and get his small payment until a decision is made.

    He knows that he had 21 days to appeal the DA decision but is there any other way now to appeal as I am sure he didn't appeal because he only thought 'well what's the point', thanks again.
