do you have to claim motor insurance under existing policy

    I had an accident in March of this year involving two other cars
    Car1 Mr. x

    Car2 Ms Y
    Car3 Me

    · basically car in front of me ploughed into car in front of her (A lot of Damage) and I couldn’t get stopped and hit her (Slight Damage)
    · I reported accident to ensure I wasn’t held liable for all 3 cars and all agreed with story above
    · I’m told I am responsible for damage to her rear but not front damage which I am ok with
    Now my issue is that she hasn’t (Car2) yet claimed against anyone and my car is up for renewal and they have reduced my no claims bonus because it’s an outstanding claim

    my insurer tells me I have to claim on last year’s policy and not my new one which would have giving me 5 years claims free and allowed me to protect my no claims bonus


    They say this is how all policies work but haven’t shown me where it says that,

    Are they right???

    You claim on the policy that was in force on the date of the accident, end of story. I can see where you're coming from but you do not have a choice in the matter.

    What you're looking to do is effectively move the date of the accident from March to July in order to fine tune your NCB, that's pretty fanciful thinking but it just wont wear.

    as coylemj says, it's the insurance policy which was active at the time of the accident which you must claim against.

    More generally, is there a reason why double threads seem to affect the legal discussion forum in particular?

    wasn't trying to move anything, i just wanted clarity on the rules to see if it was common policy, hence why i came on here

    Yes, I had to go into insurance company today and I wanted to maximise chances of a quick reply before I paid them a visit, hence why I changed the title

    Will this suffice?

    Read my post again, what I said is that you were effectively trying to move the date of the accident.

    You have very little grasp of how insurance works if you have to ask if what you were told is 'common policy'.
