Previous d2d sales rep started a new job under emergency tax

    Hi guys,

    I am posting here as I have to clarify something regarding the tax.

    During the interval 3.1.2013-25.5.2013, I worked as door-to-door sales rep for a company in Dublin. Because I thought that I won't stick around too long and because I didn't know much about the taxation in Ireland (I came over here in Ireland in October, last year) I didn't register as an self-employed and therefore I didn't pay tax for anything that I earned during that period of time. Even when I asked the 'boss' in the company, he told me to go and sort it our myself, not giving me any advice whatsover. I was getting paid on commission only.

    Roughly 1.5 months ago, I started working for another company on a basic salary. I told them that I don't have the P45 from the prev employer and they told me to fill in the 12A form. When I got my first pay slip I was under 'E' tax band.

    I completely forgot about this matter for the last 2 weeks and now I want to fill in the 12a form. The problem is that in the form I have to declare:

    "Details of any other income
    Income derived from all sources must be declared (e.g. Maintenance payments where tax was not deducted, Irish Rental
    Income, Investment Income, Foreign Income or Foreign Pensions received, etc.)"

    As I didn't pay any tax for this door-to-door sales job what shall I declare here? How I will pay taxes for what I've already earned there?

    You will have to submit a form 11 or (or form 12 if income was less than approx 3K) .

    As far I can see here http://www.revenue.ie/en/tax/it/tax-return-forms.html the forms are for year 2012. My previous job started at 3.1.2013.

    Regarding the total income, it was very little. Most probably less than 3k.

    Presumably I fill in the form 12a without mentioning about the income received from the d2d sale job and state my current job as the first job that I've got in Ireland, would I get in trouble? Can the revenue department find out how much money I received from the previous job/jobs? (I know it sounds dubious, I'm not even considering doing that but I know there are more of my former colleagues who are having similar problems so I'm just wondering for the sake of the argument)

    Why wouldnt you fill it out correctly/honestly. you wont get into any trouble for it as your return for income tax for 2013 isnst due until next year anyway

    This is because the tax due on 2013 income isn't due until 31 October 14. Forms won't be available until after the end of the current tax year.

    Don't do this. It would be untrue. The tax liability on the income from your d2d sales job is not even due yet. It isn't due until October next year under the self assessment system. If you contact Revenue they will tell you what to do. They may be able to reduce your tax credits for this year to allow you to pay it that way, rather than paying a lump sum. Contact your local tax office, you'll find the number on the Revenue website and ask them how to proceed. They won't bite. The longer you put it off, the longer you'll be on emergency on tax. It would be best to be honest about this as if Revenue audit your former "employer", they could then coming knocking on your door to ask why the income wasn't declared.

    Thanks for your explanation WildRosie. I've already started filling in form 12 and I will submit it shortly. It looks a bit complicated though but I should be fine. Cheers

    No point filling it in until 2014...

    your paye income for 2013 will need to be included

    As Citizenpain has just said, there's no point. The Form 11/12 looks for your income for the whole tax year. Revenue will just send it back to you and you'll be down the price of an envelope. They won't accept it until 1 January 2014 at the earliest.

    So WildRosie, cause I'm getting a bit confused here, what shall I do? Call them and tell the whole story? I'll have to fill in a form eventually anyway, right?

    I would suggest the above. Revenue will tell you what to do. You haven't done anything wrong with regards to owing tax so if you keep your head out of the sand and seek advice from Revenue you'll be fine.

    And yes, you'll probably have to complete a Form 12 but definitely not until 2014.
