Getting a motor caution

    Hey,

    What happens if you get an official (or unoffical) caution from a traffic garda?

    Do you get something sent to you/need to go to a Garda station?

    How long would it be on record for?

    Is there such a thing as a caution for a motoring offence? They either fine you for something or they dont.

    did he caution you ?did he say i am cautioning under section blah blah ask were you drinking ect?

    I was stopped because I drove through an intersection a bit badly and the Guard asked to see my licence - it's a 2nd learners' permit - he said that I am supposed to have a fully licenced driver with me (I know) and the Guard said that he was officially cautioning me at the side of the road and that it'd be on file. He didn't actually say what he was cautioning me for.

    It might be a scare tactic but it could also be that it will be recorded on the PULSE system so it will come up again if anything else happens. I wouldn't lose any sleep over it either way.

    He did mention about my provisional. But, he didn't say he was cautioning me for that/what he was cautioning me for.
    So, will I be sent out something about a caution, or have to go to a Garda station?

    He didn't say unofficial caution, he said official. But, I can't find details about motor cautions.

    How long would it be on record for?

    Id say he put it up on PULSE. So if you are stopped again with no fully licenced passenger with you then you will possibly be prosecuted and rightly so. Get your full licence and be worry free!

    a friend had a tip in which the guards were called,he wasnt bagged they just took his name and number,are they not meant to use the breathlyzer after all accidents now?

    well, the caution is necessary in all cases before prosecution , so it could be you will be receiving a summons. Why didn't you ask him if it was official or just a warning ?

    Did he go through the whole "anything you say..." routine or put his hand on your shoulder?

    Thats normally at the discretion of the Garda in question.

    As regards a caution, its just a wrap on the knuckles. I was pulled in town one night for apparently going through an amber, but they were more interested in the other 4 drunk lads in my car. They just needed a decent reason to pull me over in my eyes. Not that I minded as it only took 10 mins.

    However, don't be afraid to ask should you be expecting a letter / fine. If they are going to fine you, they won't have an issue in telling you and asking isn't going to induce a fine. Its a perfectly reasonable question and they have a responsibility to explain to you.

    I would advise you to bite the bullet and take the test. it will give you more confidence on the road and if you have an accident you will be able to stand your ground and argue your case

    He said "I'm giving you an official caution at the side of the road. It'll be put in the computer/file (something to that effect)." He didn't say what the caution was for, or say "anything you say, etc." My window was half up, so he couldn't have put his hand on my shoulder. Is that a part of charging someone? :confused: It seemed to me that when he said he was putting it "in the computer" that it would be entered in to the PULSE system.

    Do they send out fines and official stuff like that straight away?

    Thanks for all the replies. I've never been stopped by a guard, so I'm kind of clueless.

    I'm knd of astonished that a guard lets a learner driver off on his way unaccompanied

    *baffled*

    I thought the law had stopped this nonsense.

    OP please stay off the road unaccompanied until you pass a test, I don't really see any excuses, you made enough of a mistake that a guard pulled you over, thankfully you didn't hurt anyone.
