Would you be able to pay in instalments?

You could propose to pay it off in instalments, but be aware that a visit from the sherriff is also on the horizon. If you refuse to pay, you could end up in the clink.

Is it 5 days in prison in lieu of not paying a fine or were you just told about the fine?

Out of interest, can someone opt to do the time instead of paying the fine?

Likewise, if you end up doing the time in default, is the fine wiped out...?

    Just wondering.

I can't say it's the case for all fines but for some you can. I assume it would be pay up or a few days inside. If this is the case and you cant pay the 400 OP, you could pay the court costs instead, roughly 60 quid. I'm not sure if it's in effect but I heard the courts were bringing in community service instead of prison time for small unpaid fines.

He asked for advice.....simple advice is don't break the law....that's not me getting on my high horse that's me giving sound advice. He is whining about not being able to pay as he has college starting.....don't whine and make excuses as to why you CANNOT pay just man the **** up, take responsibility for your actions and pay the fine.

If you have to get loan from family or friends then do it. If you have to get a loan from the bank or credit union then do it. If you have to sell your laptop, smartphone or batman comic collection then do it. Take whatever hit you need to take, learn your lesson and move on but don't expect sympathy. Again the advice i give is DON'T BREAK THE LAW!

5 hours in a holding cell that's as much as you will do, if you can't afford to pay it don't pay it leave the cops come for you and take you to jail you will be left out again after a few hours guaranteed, they don't have the room to keep you there for 5 days,

i have had 3 separate fines to pay within the last 3 years and i have not payed any, just went inside for a few hours left go and fine gone happy days.

Tell me - do you have a criminal record if you refuse to pay the fine and find yourself doing a bit of time albeit 5 hours.

OP, a quick spell in prison for defaulting a fine or being in contempt of court may sound like an easy option now but think of the future and what effect having a prison sentence (no matter how brief) permanently engraved on your record would have on your future career prospects.
As bumper234 says, do what you need to do to pay the fine (legally), even if that means dipping into you college fund. If you have to defer college for another year, so be it.

Looking at your other threads. If you were able to afford car insurance and petrol( assuming you were driving legally) then you must be able to afford a fine. If I were you I would pay the fine as I personally wouldnt want to explain to employer you were in jail because you didn't want to a pay a fine for drink driving.

I agree in principle. The advice requested is what to do now and I think you should borrow if necessary to get this off your back. It could depend on what he fine is for.

What did you do to end up with such a large fine OP. was it an accumulation of several fines or multiplied because of non payment of an original one?

€450 or five hours in jail....?

    That works out a €90 an hour...

Unless you have a job which pays +€90 an hour (or approx €130 ph before tax) you'd be as well off considering the jail time, factor in the tea and lunch they'll probably give you and you'll be quids in....:)

Arrange to meet the garda with the warrant, tell them the story, arrange a time suitable to both of you to execute the warrant, buy a good book and you'll probably be out that evening, if your unlucky next day and your €400 better off and no warrant to worry about. No one need know and you'll be well fed and looked after!.

what should they do now that they cant afford it
My reading of the OP's post is not that they can't afford it, rather that they have the money, but would rather spend it on something else. Which is true for all fines I suppose.

No longer an option unless you have a decent copper that will hold the money for you until you have it all together. Has to be done within the lifetime of the warrat though, before it's re-issued. Better just to save the money yourself though.

Not a criminal record as such afaik but you do have a jail record. Any State employers can check this, likewise you probably have to declare it on Visa applications for some countries.

For what it's worth - pay the fine. Unfortunately in this country records are not expunged and you're better off not having it behind you.

All that is recorded is the original conviction.

So you have one thread asking about being kicked out of the house by your parents, another about being disqualified from driving and now you have a thread telling us that you got a €400 fine and that you will have some difficulty in paying it.

As usual, some people have recommended jail.

This thread and those foolish suggestions are a load of rubbish, OP. A small bit of common sense would go a long way.
