Balcony and Distance from Neighbours.

    Hi.

    I have been offered a Velux Roof Terrace by a friend who can't fit it due to planning issues (i.e. he bought it without getting planning for it) at half the cost price, original cost was just under 10k and as its opened it cannot be returned.

    Does anyone know if the is a distance requirement in terms of overlooking others, I look onto a sports club grounds directly to the rear, large greens with no houses to the from and side, the only houses visable to the rear would be at a 15 degree angle to the rear of the property and in excess of 50m away and this would be the rear end wall of their garden of the closest point, the actual property would be another 30 - 40 foot further away.

    As I had planned to start an attic conversion all be it with only standard veluxes to the rear this would be an ideal opportunity to give it a bit of upgrade at a good price.

    Create the worlds fanciest Wendy House :-), but seriously, the plan was to apply for planning to convert the attic but I have concerns over the overlooking rule, other regs can be met without issue but I was wondering practically how far does a neighbour have to be before it is no longer a concern, in the mean time a 5k plus saving is not an insignificant amount as I had planned to install a velux cabrio anyway at a cost of 3000.

    The issue of overlooking is a reciprocal one. If by your design modifications you would be creating more of an overlooking 'advantage' than your neighbours you would be creating 'non reciprocal overlooking' which is generally frowned upon by planners.

    If, on the other hand' your proposed design modifications allow the same amount of overlooking (reciprocal overlooking) onto your neighbours private amenity space as they have existing onto your private amenity space, then this is generally acceptable.
