Points not disclosed and small claim

    I have just discovered I have two points that I didn't disclose on my policy (my mother had just died and my partner paid the fine). I have now had a very small claim another car, should be easily under EUR500 actually should be less but the guy is not being very pleasant about it (no damage to my car - only his). What should I do ? I am so worried about it.

    If it is a small claim perhaps you could avoid insurance companies and deal in cash without effecting your future insurance rates?

    I wanted to do that, its a very small claim my guy says its no more than Eur150 and the quote the other guy got is 6 times that.. so its left me with no choice but to go through the insurance company, but my husband just reminded me of the points that I got six week after my Mum died (she died suddenly of liver cancer). In fact now I am thinking do I have the points ? I can't find any record of it. But I am worried will it make my insurance policy null and void.

    Some insurers like Aviva increase excess if you don't tell them about points, other expect to be informed at renewal.

    can they check ? If you google it it says companies will now have access to this but since when ?

    Who are you insured with? 2 points shouldn't matter and with the exception of Aviva, none can check.... As far as I know anyway.

    you can check with the road safety authority if you have points

    Did you get the points between renewals or get the points before renewal and not disclose when renewing?

    Should say some... Some state to inform them about points at renewal, some expect to be told as soon as you know, and others - like Aviva - encourage by increasing excess if you don't tell them.
    For some companies 2 or 4 points isn't material fact, hence they allow to tell them at renewal.
    Checking policy doocuments is the best way, but it isn't always easy to find.
    Small print I suppose...

    No I completely forgot about them genuinely completely forgot. As I said my mother had only died six weeks before and it completely went out of my head. So can they check I am with RSA. ? The claim is tiny too that's the killer. But I am worried they will revoke my policy.

    If you can pay outside of insurance, thats the best in either case. If not, you have to suck it up. How do you know you have points if you cant find evidence?

    I had completely forgotten until my partner reminded me. But yes I can't find a letter for love nor money, I have gone through all the old files. I will try and call the NRA on Monday to find out, but in all honesty I don't ever remember getting a letter - do they always send one? However, it was a very difficult time (My Mum died, my Dad got seriously ill and my son was diagnosed with three different spectrums of special needs). I would quite happily pay outside the insurance but the person concerned is being very difficult and nasty and the quote he has given me is 6 times the amount of the lowest quote I have got... so I really don't know what the best option is. I also checked how muct extra my policy would have been with declaring the 2 points and it was exactly the same amount.

    This is what the current RSA policy document says about points....

    8 Disclosure of Penalty Points

    If you, or any driver whose driving is covered by the Policy, are convicted of and offence under the Road Traffic Acts, this is a material fact and the following information must be disclosed before the next renewal date of the policy:

    1. The type of Offence(s)
    2. The number of penalty points imposed for the offence(s)
    3. The dates of conviction(s)
    4. The Driver Number(s), printed on the driving licence(s), of the driver(s) on whom the penalty points have been imposed.
