Land Lease - Advice wanted

    Ok we got our hands on 8 acres of land in April to rent till November of this year to get us over the slump in grass growth. Anyway it took the pressure off us big time. So anyway, the OH (She is herd owner on the books) did the deal with the Mrs Land who owns the land, agreed and settled up.

    Anyway the problem is the 8 acres are around Mrs Land house and Mr and Mrs Land have a stinker of a divorce going on and Mr Land isnt fecking happy at all. So Mr Land (An ex Dept of Justice employee ;)) starts calling my wife right up till 12 midnight for 3 weeks non stop. Then sets the Dept on us a week before 31st May and now has solicitors on it.

    But Mrs Land wants us to leave the cattle there as the agreement is done and she is trying to get a barring order against Mr Land. Now my law experience is we have entered a contract with Mrs Land.

    Apart from going to a solicitor, any advice would be great.

    wonder who the lands name is in. Was it Mrs Land's land to lease. when you say he has set the Department of Ag on you - In what way??? Pocession is 9/10 as they say and just remind him that if he is to move the animals he is interfering with your property. The Dept of Ag will have no interest in who owns, rents etc the land. Cheque cashed in Mrs Land's account. What are the solicitors letters claiming, doubt he will take the matter further than a worthless solicitors letter, tell him you will be gone in November and also remind him that calling a poor woman for three weeks in a row late at night is a harassment offense which he should already know. What's the missus like???:)

    8 acres would only be a holding pen for you bob. One in every county would be handy though.

    If it was me I would have a word with mr land and tell him you have it paid up til november , if you think there is just going to be hassle still from him after talking I would go to mrs land and get your money back and forget about the 8 acres as it would just never be worth it .
    Probably not great advice but if a lad was ringing my wife at that hour of the night I would burst his snot with a clatter (any wonder his wife is leaving him if thats the kind of sh1te he is at

    On the "busting his snot" - he is an ex cop :rolleyes:, fairly high ranked.

    He used her car reg to get the home address and phone number. Corrupt fxckers some of them

    he did fcuking what, id tape that bastards next phone call and report him, and if he cant see who smacked him on the snot then he cant follow anyone;)

    that whole situation might be more trouble than its worth, you annoy the ex copper and he will be out to get you, but at the same time you dont want him getting one over,

    sorry not much help but the way some high ranking ex cops carry on really annoys me

    As ManofFeeling says if it's on your SFP and you've paid fully, then you are in a strong position.
    Problem is was Mrs Land entitled to let it to you?
    If he rings again, tell him to fe*k off and get his solr to write to you.
    See what they write, but it may take so long for them to get anywhere that you will have vacated in Nov before there's to much done about it.
    As if farming wasn't hard enough without that sh1te!

    The land is paid for, and we didnt claim SFP, but did claim the mapped area.

    His solicitor is looking for tresspassing.

    I know its only 8 acres but it was key to my grazing this year.

    Have you got a written contract with his wife?

    Don't know how he can claim you are trespassing to be honest but do you really know who owns the land?

    Tell your wife to turn off her phone at night;)

    With all the fuss about inappropriate use of the pulse system (and other gov databases) would it be worth contacting your local superintendent and telling them how concerned you are at this man's ability to get your wife's information and the way he used it afterwards?

    It might cause him to back down a bit if he was asked to explain his actions.

    you have proof of payment, proof of use (SFP application) so that puts you in a very strong position. But with animals one always has to be careful as something as simple as a couple of lead batteries thrown in the field and your screwed. He will also have one of his buddies do you for something as he has the "law" on his side.

    The post about contacting the local super intendant (and or the Garda ombudsman) might be a good idea, at least there's a record of his messing and he'd have more trouble getting serving friends to do "favours " for him... (i think a Garda has to be signed in to use pulse)
