Got stung buying car.

    I bought a car 3 weeks ago I seen the add on done deal the car was 1500 I rang the seller and it was a women on the other end of the phone I thought to my self great the car will be fab. I went out with my daughter viewed the car drove it loved it now it did not have n c t I know a big mistake this car was spotless inside and out so I bought it she gave me 50 euro for n c t she said she had car 2 years and it was perfect i even have the add with picture saying 100% perfect she was chatting away to me and my young daughter about the car her husband was there but he had no English. I had a car check done on car before I left so happy enough nothing seems wrong with the car I paid and left a few days later I started have a few problems I had n c t booked I decided before it I would get car checked out the bad news was the head gasket was gone and few other things too would cost 1200euro to fix I was heartbroken so was my daughter I drove out to the house where I bought it and the women would not come out to speak to me I rang and after a lot of phone calls her husband answered the one who we were told had no English well my god the words that came out of his mouth was unreal the abuse he gave me he told me that I done the damage he laughed down the phone when I said I wanted my money back he told me to go away or he would call the police I told him get the police after a long wait I went to the police myself and was told there was nothing I could do I went home that night in a state and I sent her a text that I wanted my money back I got no reply. The next day I got a phone call from the police telling me they had a complaint from a couple that I was harassing them and I was warned to stop what can I say this country Is a F...... joke I just want to let people know whats out there even for a women to do this ............ it sorry did I call her a women....... that's a mistake............ I have made lots of phone calls i wanted to bring them to court but i keep coming up against a brick wall family have told me to leave it and move on but i am finding it so hard to do.

    Agreed with dharn, private sales are sold as seen, will be hard to get money back.

    You have unfortunately learnt the hard way.

    If you dont know anything about the greasy bits, call a mechanic.

    All private car sales are sold as seen, no legal exceptions

    It is of course possible that nothing was wrong with the car when they sold it to you.

    BTW I would have been straight on to the Gardaí if you done the same to me.

    Stay away from them and in future bring a mechanic with you

    Perhaps even better would be to say in advance that you're bringing a mechanic friend instead of just showing up with one. If the seller gets cold feet you'll know it's not kosher.

    The sad part is that it's often the poorest people who are defrauded the most - a richer person can either buy new and get a warranty or second hand from a reputable garage.

    Very difficult read but I think I got the gist of it.
    If a car is being sold by a man, woman, giraffe or polar bear it makes no difference. They will all be equally honest/dishonest. No matter what, if you are not mechanically minded get someone who is to look over the car before parting with your money.

    When I was helping fight Nigerian scammers on eBay I read that males often use women and foreigners to speak on the phone as people are more reassured by a female voice.

    Though perhaps you're right.. We should claim this is sexist and throw a hissy fit like certain of the women's rights brigade did last week when some of us had the audacity to tell them they were wrong. :-)

    AFAIK its only from a dealer.

    Private sales are private sales so sold as seen. If you were sold a dangerous lemon, the onus is on you to prove that the seller knowingly sold you a dangerous car. This is easy to prove from a dealer as they should know about cars. Your average jane/Joe doesn't.

    Yes, it should have been "woman"

    There is nothing you can do. No point harassing them and ranting about court - it was a private sale. Hard luck, bring a mechanic next time

    Tallon is correct; it is section 13(2) of the Sale of Goods and Supply of Services Act 1980
    (2) Without prejudice to any other condition or warranty, in every contract for the sale of a motor vehicle (except a contract in which the buyer is a person whose business it is to deal in motor vehicles) there is an implied condition that at the time of delivery of the vehicle under the contract it is free from any defect which would render it a danger to the public, including persons travelling in the vehicle.
    This is limited to dangerous defects and I'd be surprised if it was of any assistance to the OP.

    It's been my experience that people who say "get your facts right" are the most prone to jump to incorrect conclusions themselves.

    surely if the head gasket was gone when you took it out for a test drive you would have know?
