    Amendment of Control of Dogs Regulations

    Dear XXXXX.

    I am directed by the Minister for the Environment, Community and Local Government to inform you of changes to Control of Dogs Regulations, which will come into operation on 1 June, 2013.

    Summary of the changes:
    - to increase the fine for not having a dog licence and other offences from €30 to €100;
    - to allow fixed penalty notices to be issued for non-muzzling, non-leashing and “non-control by over 16 year old” of a dog that should be muzzled, leashed or controlled by a person over 16 years of age and
    - to exempt members of the Canine Unit of the Irish Prison Service from (i) the need to have a licence for dogs used in the Service and (ii) from any requirement to muzzle and leash any such dog.

    These changes are being implemented following discussions with Local Authority staff involved in the Dog Control function and with the Irish Prison Service.

    The new Regulations are the Control of Dogs (Amendment) Regulations, 2013 (SI No. 156 of 2013) and should be taken in association with the existing Control of Dogs Regulations, 1998. A copy of the text of the new Regulations is included in Appendix 1.

    Control of Dogs (Amendment) Regulations, 2013



    I, Phil Hogan, Minister for the Environment, Community and Local Government in exercise of the powers conferred on me by sections 5, 19, 28 and 31 of the Control of Dogs Act, 1986 (No. 32 of 1986) (as adapted by the Environment, Heritage and Local Government (Alteration of Name of Department and Title of Minister) Order 2011 (S.I. No. 193 of 2011)), hereby make the following regulations:

    Citation

    1.​These Regulations may be cited as the Control of Dogs (Amendment) Regulations, 2013.

    Commencement

    2.​These Regulations shall come into operation on the 1st day of June, 2013.

    Interpretation

    3.​In these Regulations :-
    (1) “Principal Regulations” means the Control of Dogs Regulations, 1998 (S.I. No. 442 of 1998) as amended by the Control of Dogs Regulations, 2011 (S.I. No 700 of 2011).
    (2) “Act” means the Control of Dogs Act, 1986 (No. 32 of 1986).

    Exemptions from certain requirements

    4.​The Principal Regulations are amended by inserting after Article 7(1)(d) the following:

    “​(e)​kept by the Canine Unit of the Irish Prison Service,”.



    Exemption from holding a licence

    5.​The Principal Regulations are amended by inserting after Article 8(b) the following:

    “​or

    (c)​a member of the Canine Unit of the Irish Prison Service,”.

    Prescribed amount for certain offences

    6.​The Principal Regulations are amended by substituting for Article 10 the following:

    ​“10. The prescribed amount for the purpose of Section 28(1) of the Act shall be €100.”.

    Prescribed form

    7.​The Second Schedule to the Principal Regulations is amended by the substitution of the form set out in the Schedule for Form No. 3.

    It makes no mention which dogs are required to be leashed and/or muzzled in a public place.

    This is an Amendment to the 1998 Control of Dogs Regulations, in which you'll find the 11 listed breeds/types (ie Bandog).

    It makes no mention which dogs are required to be leashed and/or muzzled in a public place.

    They're there. They are new to the fixed penalty list. 3rd last and last. They were always an offence but not listed for on the the spot fine as they are now.
