Speeding Question

    Hi,

    Don't know if this is the correct forum. Was caught by an unmarked car speeding doing 80km in a 50km zone. My first question is can I contest it on the grounds that there was no speed sign highlighting the drop from the previous 80km limit to 50km so I wasn't to know. Secondly the guard led me to believe that he gave me the benefit of the doubt when letting me go ( no mention of fine/points, no document stating I was caught speeding) just telling me to keep an eye on my speed when handing back my license.

    Did the Garda take your licence into his car for a few mins.? Did he have a speed gun? If yes then you're getting points. He's not going to let you off that kind of infraction when he was operating a speed trap.

    80 in a 50 zone is truly excessive. You'll probably get slated here, but I think it depends on where you were stopped. If you were doing 80 through a village or town etc you deserve the book thrown at you.

    I'd be very surprised if there is no sign to show the change in limit, but if you can prove that the sign either isn't there or that it is sufficiently obscured so as to block it from sight then I'd say you would have a decent defense.

    What the Garda said at the time is largely irrelevant as it would boil down to your word against theirs.

    There's a good chance he still did you.

    I've found that Gardai don't mention anything about the pending fine for an easy life.

    He doesn't have to give you a ticket.

    Can you elaborate on that? Did they specifically say 'benefit of the doubt... let you go'? If so, I'd say your in the clear. There's a possibility the sign was removed / replaced and he only copped it after he pulled you. Its certainly grounds for appeal if you can prove it. I've been pulled once or twice late at night in town on the grounds of something i.e. Ran a amber light (When I didn't, DVR etc) only to be let go after a chat. They're just checking if I had 'drink taken' but generally need something more concrete to justify pulling you in.

    Just as an FYI, the Garda doesn't need a gun to pull you for speeding. Unmarked cars can 'pace' you car i.e. Your going faster than them and some (rarely) are equipped with radar (Not photo radar)

    IF he did you will be done. If he didn't write down stuff in front of you then you may not be done.

    The procedure is usually more formal than merely glancing at your licence and telling you to mind your speed.

    He may want you to be uncertain of your fate as a form of penalty.
