Small Claims advice

    Hi I have an ongoing issue with a smartphone which has now been off for repair for over a month. I have informed the company from which I purchased the phone from (unlocked) that I will be taking a case to the small claims court if I don't receive my phone back by Wednesday (5 weeks approx since its been sent off).

    The phone cost over 700 euro and I really feel I should make a stand on how this is being dealt with. Having read some info on the small claims court proceedings I am still a bit unsure of what costs could be involved. Particular references to counter claims?? Can a just find against you and make you pay money??

    Finally in terms of giving evidence on the issue. I can't afford technical experts but I have taken a number of videos demonstrating the issues with the phone. Can these be submitted/will a judge consider them?

    Any information would gratefully appreciated

    €25 quid is what it costs. Counter claim is very unlikely unless you broke the thing and have insisted on it being looked at by an engineer.

    From what I can gather it's relatively informal and there is no need for technical reports etc. However if it's a fault of a particularly technical nature, very specific or intermittent you might want to have some half decent record of the issue.

    This is not legal advice - I'm simply treating it as if it was in the consumer issues forum. I'd suggest doing a search there OP. The fact that it's been away for the period of time it has is already an issue under consumer rights.
