Supreme Court Judgment on REA

    The Supreme Court has declared the Registered Employment Agreement (REA) system unconstitutional,

    I was working as a construction worker for several years (Electrician) and
    I was forced to pay into the construction workers pension scheme (CWPS).
    I did not want to be the scheme but it was the "law" under the REA and now that REA has been declared unconstitutional.

    I also see on the CWSP site in the news section a story about 2 company directors that were jailed for breaching the scheme.

    What do you think the fall out from this will be?
    Will I be entitled to my contribution back?
    I dont think I paid a massive amount of money into it but thats not the point.

    I've been told that a lot of this money I payed ended up the pockets of the TEEU and this boils my piss.

    The CWPS Trustee Board are meeting to study the implications of the Judgement and they will communicate with the membership in due course.

    I would be very interested to here if anybody is lodging a claim for redress from the CWPS. I work for a plumbing company who the CWPS done a review on in 2010 and calcuated a Large arrears bill based on our P35's for 2008, 2009 & 2010. We are paying this bill in monthly installments, but the employees never wanted to be in the scheme but we were made to pay this balance. The CWPS now say that this arrears balance will have to be paid, but we can remove all employees going forward. I would like to hear your idea's on whether we would have a case against them.

    I have searched boards for an answer to this question also. My husband isnt even an employer or in construction anymore yet has an outstanding arrears balance with cwps and his employees didn't even make their own contributions at the time and my husband didn't deduct it from their wages. Yet he is paying an agreed amount each month until this arrears is cleared, but we are talking about another 5 years. Now it seems the REA is unconstitutional can he just stop paying these arrears? Did you get an answer to your own query?

    Well, we did nothing, just stopped making the payments, and CWPS never once rang, emailed or sent a letter requesting further payment. Its over a year and a half later so I think its safe to assume it has been written off.

    What about a refund for payments made? A solicitor may advise
