Cert of Exemption for Planning Permission

    I am in the process of selling my house but the buyer wants me to get a cert of exemption for planning permission for an extension we put on at the rear of the house 2 years ago. The area of the extension is only 25m2 and there is still loads of room to the rear and side of the house. The council said I did not need pp but the client is now demanding it. Do I have to give this to him and if so how much will it cost for me to get this cert? I am already selling for a loss and cant afford this kind of stuff if it is not necessary.

    Yes you will need to provide either the cert as mentioned or a part 5 declaration from the local planning office - word of mouth doesn't work well when you are into the legalities of a sale.

    The solicitor acting for the buyer will insist on this and he wouldn't be doing his job right if he didn't request it.

    Like most things it depends on who you get and whats involved and where you are located. I think you're in the Letterkenny area so expect to pay anything from €100 - €200 but thats just an approx figure as other factors have to be taken into account.

    While you are here maybe you can answer a few other semi related questions.
    We are selling for a small loss, about 15K. Will the full sale price go to the bank or do my legal and estate agent fees come from that figure first then the bank take the rest?

    Interesting question but unfortunately not something that Im directly involved with.

    I assume you have a mortgage and when you say you're selling at a loss you mean that the sale price is less than the outstanding mortgage? Like any sale the money will transfer from the seller (or his bank/building society) via his solicitor. This money goes to your solicitor and he/she will deduct their own fee first and then the balance goes to the bank.

    As for estate agents fees, surveyors fees, BER assessors fees etc I really dont know. I would imagine that all these matters are contained in the contract/agreement that you will sign so your solicitor would be the best person to ask.

    You would imaging the solicitor would be the man to ask but he has been far from helpful throughout the whole process. Unfortunately, well for this process at least, I am living in New Zealand now as I had to move to find work so I am as far removed from the transaction as I can be which is problematic at times to say the least.
    I asked the solicitor last night and he said his fees were my responsibility and the money would go straight to the bank which was against what I had heard before going ahead with all this. When I replied to this he dident bother to respond.
    I was told initially, unofficially that all fees would come from the sale figure.

    Request him to email you a copy of the legal arrangements that are in place for discharge of ALL professional fees associated with the sale.
