Got ripped off on ebay

    I know I should've known better, but I 'won' an auction for a Samsung galaxy beam, ( I gave mine to my son) and the guy was on to me like a shot to be paid. A week later, no phone, no contact from the guy based in swords, and I've opened a dispute with PayPal. As I paid with credit card, could I get redress that way I wonder. What are the chances of me getting the 90 euro back ?
    The reason I should've known better is the guy who calls himself / herself Bruno Serban, had no feedback, and had only joined eBay 2 months ago.

    Tough luck man.

    It would appear to me that you have paid PayPal to make a transfer to that joker, PayPal have done just that so your card issuer won't entertain any chargeback.

    If you had paid him directly you would have had a chance, although not sure if there is a minimum amount for cc protection. I know that in the UK it is £100.

    I had to get onto ebay for a number of things in the past. lost items and the like. open a dispute report with them. see how that goes or get onto the credit card company do a charge back for the amount. but run it by ebay first.

    Don't panic just yet -- you have paypal protection .

    Its only been a week , and you have 45 days to register a Paypal claim .

    Check the item listing again , and see how many days are down for processing .

    Check the listing for item location , to see if the phone is actually in Ireland or maybe HK / China .

    Apparently the phone is in Swords, the listing had said no posting to the Uk, as I had had my parcel motel address registered ready. I tried to ring this person, mobile number switched off , they have my address and phone number, and all I've got is a number that doesn't work. So I do hope the eBay buyer protection covers me , when I went to open a dispute, eBay directed me to PayPal , and PayPal was directing me back to eBay ! Thanks for feedback , it helps to know I may have a chance as like most people that's a lot of cash to lose.

    I had no credit with PayPal so paid with credit card processed through PayPal.

    If the seller is not responding to you just file a claim with PayPal. You have 45 days from the payment date to do so.

    Send a few messages/e-mails via e-bay to the seller to show that you have tried to contact the him. Any time I have had to open a dispute, E-Bay has asked, have I tried to contact the seller and it is easier to point to a message sent via E-Bay than to prove you made a phone call.

    You're definitely covered by buyer protection having paid by paypal, Ebay is a far better place to be a buyer than a seller. You need to open a dispute and the money will be refunded to you eventually... The ebay boards are great for advice on this kind of thing :)

    I've had about 3 undelivered items over the years on ebay and every time Paypal has fully refunded me after I filed a dispute.

    you say you've opened a dispute. My guess is he won't respond within the timeframe given, if that happens Paypal should refund you.

    dont worry as long as you have paid te item via the PayPal checkout. According to the rules the Seller has now to proof the shippment. If he cant you will get your money back directly. Have you openend the item not recieved case?

    I ordered a micro SD card from a seller in Raheny, Dublin a few weeks ago. After a week I sent a 'contact seller' mail to the seller to find out if he sent it. It seemed to start a case immediately. The seller had up until a certain date before the case escalated to a dispute. On the day the time ran out I got an e-mail from ebay to find out if it was sorted. I replied that it wasn't. The case was escalated to a dispute, a decision made and a refund in my Paypal... all in about 5 minutes. :eek:

    Thanks for the feedback , someone else who got ripped by the same scoundrel emailed me - he got a refund eventually, today's the last dispute/claim day, fingers etc crossed...

    Paypal can take it out of his paypal account if he has not withdrawn it. I expect even if he has withdrawn they can chase him via his bank details.

    Otherwise it can come down to insurance, which leads to higher charges for everybody on their premiums. So its bad to have an attitude of -"sure I'll give this website, www.dodgy-rolex-dublin.org a go, sure I can't lose, paypal will refund me"
