    Someone scraped my car and continued to drive on back in December. I got the reg contacted the Gardai on the same day, they took details and said they'd get back to me. I had to chase it up with them several times and it was January by the time I got the owners name and no. Contacted her she agreed to pay, I got a quote, she asked me to wait til end of Feb and I agreed.

    Feb, Mar, Apr, came and went, I haven't made contact with her as I ill for a while and it wasn't a priority. I am now in the position to get this sorted out but wanted to know if I have left it too long? I don't want to make contact with her again until I know the facts just in case she refuses to pay now that a few months have passed.

    Anyone know if I am still within my rights here?

    Did you contact your insurance or her company at time? This is one of the reasons you pay them.

    The fact that she didn't stop inititally and still hasn't paid upto now would suggest to me that she isn't going to pay up volunterely. If it were me I'd have been involving a solicitor/insurance companies along time ago and no longer deal with the person directly.

    I know with my insurance company if you don't notify them within 24hrs of an incident your'e on your own (you dont have to claim, just notify them). So I doubt they'll be willing to act months after the fact.

    Contact her and tell her that 1. You are making an official complaint that she failed to remain at the scene on an accident and 2. You are making a claim through her insurance company which will effect her NBC unless she forwards a bank draft for the quoted amount within 5 working days. If she fails or refuses then do both of the above.

    There is a 6 month statutory period for making a statement to the Gardai so you have time left to do that and as far as I know there is a 3 year statutory period for making claims against insurance although I may be incorrect on that.

    At this stage, I would cut off all direct contact with this person. Go to your insurance company and have them deal with it at this stage. You are doing this person a favour by not going through their insurance. If they start to take the piss, well screw them. You pay your insurance company a lot of money to cater for these situations. Use it at this stage.
