single farm payment question

    Hi guys, just a quick question on the SFP.
    My boyfriend is a dairy farmer, about 6 years ago he was left land in a will by an elderly grand aunt bout 40 miles away. the land includes 5 rough grazing ground and commonage of about 25 acres down the road from there. he gets the money for the 5 acres but when he applied for the commonage he was told that it is already being claimed. presumably some cute fella must have got the folios years from her and has been claiming since.
    He went to the IFA and his teagasc advisor and they went about trying to sort it but got nowhere. if he applies apparantly he will be fined as its already being claimed.
    Honestly I cant understand this, surely its up to the department to figure out who is claiming in the wrong. my boyfriend has given up on it but I feel it shud be sorted.
    Have ye any advice, i suppose its getting too late to sort it before the deadline.

    Maybe there are different rules to claiming SFP on commonages.


    What I say from here on is if the land was lowland considering I dont know commonagies rules for SFP

    The rules if it was a lowland farm would be that you boyfriend is entitled to use the claim for the land as he is the owner. If there is someone else claiming money off it, its fraud unless there was an existing lease from before the woman dying.

    To claim for it this year simply get the maps and include them with your SFP. The Dept will write to you's in a few months saying there is a dual claim on the land and for you to prove your entitle to claim on the land. If you prove your the owner I can see the other guy having a leg to stand on.

    There probably isnt an SFP on the ground but there more than likely is a DAS payment

    Hi there,I'd be curious about that situation as well.My own cousin got left 65 acres a few years back and she knows nothing about grants/supports etc.She has been renting it out for a few years to a local lad who puts cattle on it and then he gets silage off it later on.Would she be entitled to anything,as she has'nt a clue and neither do I,tbh.
    Also she told me the land gets a fairly bad dose of ragworth every year.Who is responsible for that, Her or the farmer? And who's responsibility is it to get rid of it?
    Any help would be appreciated

    she is entitled to the rent, if she is only leasing it out to a farmer.

    Ragworth is the responsibility of the farmer

    Just bumping up this old thread as I have a query,

    If you were to buy land this year say, and the sale wasn't finalised for a few weeks after the SFP deadline, and if both you and the previous owner claimed for in in your SFP who would actually be in the right?:confused::confused:

    I think there's a date around the 30may and who ever is farming it on that date is entitled to claim it......check it out with dept

    Don't think it matters, entitlements are now based on lesser of what was farmed in 2015 and 2013 afaik

    It's still in the terms and conditions that you have to have the land on 31st may, otherwise there'd be dual claims all over the place
