Renter/Neighbours building on property!

    Just a quick query - but some tenants/renters have decided to build on their rented property and through the grapevine, it is believed that they are going to open a hairdressing salon in their back garden! (I am NOT kidding). Can I complain to the council without becoming involved (we have had some problems with them, BUT my stance is that as long as they don't make nosie when my baby is sleeping, I could care less, however, we do grumble about the fact that they block us in parking wise and for a few months, they put their rubbish in our bin (I caught them one day when I was home sick as I didn't put our paid rubbish out and the bin men knocked on our door about the green bags...but we never confronted them for a variety of reasons...) am I justified in complaining to the council?

    it became an issue this morning when their builders started work at 7 am (on a Saturday) and woke me and the baby up (teething meant it was a hard night and LO was NOT happy being woken up)....am trying to be a good neighbour but isn't there a point were it just becomes ridiculous?

    If they already applied for and received planning premission then you missed your window to complain.

    I don't understand. If the neighbours are renters, then surely the landlord must know/ has to be informed.

    Did you do that?

    1. You need an engineer and solicitor

    2. Contact owner of house.

    3. Check if planning granted and Building control notice of commencement served. Planning permissions can be checked oniine in many areas.

    4. If there is no planning permission contact Planning Office in your local council.

    5i If due to budget or other reasons the Council is slow to act, you can apply yourself for an injunction.

    6. Work starting at 7 a.m. on a Saturday is suspicious. Even if there is p p there are often conditions about working hours

    I would of assumed to get planning permission, they would of had to take out ads in their local paper and put a sign in the front garden for a certain length of time. It gives people the chance to object.

    You can be pretty sure they didn't receive planning permission for a commercial development (i.e. a hairdressing salon) in a residential area (i.e. the back garden of a house)....

    If (and its a big if) they actually received planning permission it will be for standard extension to a dwelling (sun room, conservatory, kitchen etc) or a detache workshop or garage for private use, not for a commercial premises.
    Have a look on your local council website, most of them have their planning processes online so you can search through all the applications. Also have a look at the local development plan (also usually online), it will tell you what sort of development is permitted in your area and commercial premises in the middle of a residential area would be highly unlikely except in specially designated areas of the development.
    If you're having parking problems with them now, just imagine what it will be like when they get their salon up and running....?

    Just get on to the planning enforcement section in the council and they will deal with it. They're well used to handling complaints from neighbours about other neighbours so they will handle your complaint discretely and wont name you.

    Most likely all they will do at first is send a letter out that they have received a complaint and are starting an investigation which also details the penalties, which is up to 5 years in jail or a big fine and that is normally the end of it.

    Do not raise these issues with the planning department as your complaint will be seen as vexatious.

    You can of course raise the matters with the neighbour and if there is repeat misbehaviour seek resolution - the council roads department / Garda about the parking and the litter warden about the litter.

    If its a private estate the Gardai won't be of any assistance....
