I've been through this with NoE.

It was not easy and it was not quick, but most of the delays were with the Gardaí rather than Nintendo. They have a process that's designed to work with the British police system, and our boys work a little differently. You need to officially report the handset stolen or lost (including the serial number if possible, which is recorded on your box, the 3DS itself and they can recover it from your account if you use the AskMii service on the Nintendo repair site), get a reference number, they follow up to confirm that the details have been correctly logged. Then you send them your new 3DS and they transfer the account over.

Alas, the Gardaí don't give you a reference, they give you a "leave that with me, so" and they didn't take down the details properly...

Still, got there in the end. And at no point did they tell me that it was hardware tied, f-off.

Still, its a ridiculous system to have content tied to hardware rather than an account. You should simply be able to de-authorize the console & download your account onto a new consoles complete with transaction history.

I think Nintendo said before they will address it in the future & move things to an account based system like everyone else does

I agree completely - not saying I condone the system, just that it's not as bad as the article makes out (in my experience anyway)

With the WiiU account system it looks fairly clear that they're toying with fixing this, but they're not in any rush

Agree. That's why u buy digital games for ps vita and only hard copies for 3ds. I got monster Hunter 3 on sd card, because that's how they sold the bundle ( bastard), but I am going to buy a hard copy of the game when it drops in price too. Having game tied up to a console is just stupid. Specially at this age.
