NCT Data Protection? WTF???

    Bought a 1990 mini last week. No NCT. Owner says car failed only on rust on passenger door. Car going into bodyshop today to get that and other stuff sorted. NCT have no dates in Ballymun since the 17th. I asked what the car failed on and was told that because I wasn't the owner of the vehicle when it was presented for NCT and because it was more than 28 days ago, I can't be given that information due to data protection law. The guy said that there would be personal information recorded. "what personal information?" I asked. Who, where and when it was presented was the answer. I said I didn't need any of that information and as the current owner, I only wanted to know what my vehicle failed on when it was presented for the NCT. Should I not be entitled to this information? What if it failed on something serious that I missed? This is fcuking ridiculous!!

    EDIT: I'm just thinking, why would the data protection act not apply within the retest period? This makes no sense at all to me.

    If they can't give you the information, they can't give you the information. Ask the seller for the fail sheet.

    Does seem a bit ridiculous though in fairness to the OP.

    People get advised to ring garages before they buy a car all the time here. Does the garage just say "yes it was serviced..." or will they give the details?

    It ridiculous but it's the law. I rang up to pay my sisters phone bill on my card. They wouldn't do it because it would result in them charging my account the amount owed on her account therefore indirectly giving me her private account information. In the end I rang up in a horrible attempt of a high pitch voice pretending to be her to pay, then had to pass the phone to 'me' because I was paying in my card. The CS agent knew exactly what was going on but they didn't care. As long as it was shown that they were following the law they were happy.

    Not sure why the seller couldn't give you the fail sheet but possibly you can show up at the centre with the logbook and say that you lost the fail sheet and could they please print you a new one?

    I rang UPC to pay a bill and had a conversation of basically they wouldn't talk to me unless I was the account holder.

    So I just hung up and rang back with a fake accent and asked if I could pay with my friends credit card, they said no problem, was a bit silly in the end :pac:

    Actually no its not. Data Protection Act covers "personally identifiable information", not "any information", which is what the Emission level on 1990 Mini definitely falls into.

    It was a friend of mine who rang about the car and the seller said it only failed on the passenger door rust. The seller said they had the fail sheet, but when we drove from Dublin to Mullingar, the seller could not find the fail sheet :rolleyes:

    The logbook has been sent off, so I don't have it. It would have been tested in Mullingar, but I am having it tested it Ballymun.

    That's pretty much what I was saying over the phone. I was looking for safety information on a vehicle I own. I was not looking for information about the previous owner....not even when th car was tested last, just what it failed on when it was tested (if it was tested).
