right to refusse a self Asse ssment

    this week i found an employee in the middle of an act of gross mis-con-duct. she was reprimanded and sent home on the day, with a view to further action. no action has been taken as yet.

    when she finished today i gave her a self asse ssment form to fill out, where i asked her to identify the tasks she felt she was responsible for, to rate herself on the identified tasks, and to give a reason for the rating she had chosen.

    she just notified me that she is refusing to fill out the asse ssment.

    we have just completed our own asse ssment of her work and she is failing on every front - and i say that categorically, not because i am 'on tilt'

    we do not have a formal contract and she has never received a written warning, although has been pre-warned in the past about said mis-con-duct, as it was noted that the opportunity was there and it might arise.

    can anyone advise what my position is with regard to letting her go?

    She has no written contract and she has never received a written warning about her previous conduct.

    Can you let her go? Yes, but hold a large amount of money for the unfair dismissal claim that she will probably win.

    Where was it noted? You said she has no formal contract of employment.

    If you were aware of that risk then you should have included that in her contract of employment.
