Speeding Fine Query

    A friend was recently stopped for speeding and he received his penalty notice.

    On the notice it said he was doing 86km in a 60km zone, the fine been 2 penalty points and €80, providing this was paid within a certain time.

    I don't know if this makes any difference to matters, but when he was stopped, the gardai told him he was speeding at 84kmin in the 60km zone.

    It would be interesting to know if this has happened to other boardies before, and potentially could this lead to the notice been cancelled if my friend decided to appeal this notice in court.

    Minor typo, won't make a fiddler's difference. If your friend takes it to court my guess is the judge will probably just ask him which of the two speeds he was doing, make the necessary correction and still convict him since both are well in excess of the legal limit. Either that, or he'll just ask the Garda which reading applies, with the same outcome for your friend.

    Arn't the points doubled if you appeal and fail?

    He'd get double points if he loses in court.
    Just pay the fine now, he did speed.

    So a guy was speeding, gets caught, cant handle he got caught and is looking for a way to get off with it??

    I wouldn't go to court. You were well north of 60 at the time. Its amazing how the fine here is the same no matter how fast your going. Out of interest, would people slow down if it was scaled? Say €80 for every 5km/h over?

    Well actually it is a friend:) funny comment, oh well.


    He will pay the fine no worries there. I just thought it was strange that he had been accused of speeding at x speed and then the penalty notice mentioned a different speed and based on that inaccuracy could it be challenged, I guess that's for him to decide.

    Very rare to get points in court for speeding. Most just get an increased fine or donation to charity. Have first hand experience of it this month after being out of the country for 3 months when fine came. Dont blame the people, blame the system.

    Its actually fairly unique for them to tell you the exact speed. In fact they don't even have to prove it. They can just say your speeding even if the laser gun is miles out of calibration. No one has the money to take it to the higher courts for a test case.
