Reps 4 over claim question

    I have a question about a reps over claim. The payment reduction is 100%. When the orchard was planted it wasn't fully to the Reps guidelines. There is supposed to be 7m between trees and a total of 500 sqm. These two conditions weren't met. Is this the reason for the reduction in payment? If I replant the orchard properly can I then claim again or have I forfeited the payment altogether meaning I just leave it as it is?

    I can't help you I'm afraid, have you a planner? That would be my first port of call.

    Looks like they think you dont have it at all. Two possible reasons, 1. you had an inspection and there is no orchard on the ground or 2. you forgot to mark it out as a separate plot on your 2012 SPS application. if this is the case you could try amending your 2012 SPS and appeal the decision once the amendment has occurred. worst case scenario is you pay back whatever payment you have gotten so far and no possibility of getting it for the remaining years. As previously stated first port of call should be your planner.
