Why the non payment of state owed money?

    Was looking at cases of unfair dismissal recently and thought this was strange. If i get sacked from my job and take an unfair dismissal case i could be in receipt of welfare payments for a number of years while waiting for the case. If i win the case the total awarded is minus the amount of welfare payments. So i could get 90k but been on welfare for 3 years so 36k gets taken off that figure. However that money is never paid back into the government coffers. Anybody know why?

    Hi there, As far as I have read in all cases Social Welfare is not deducted as it is not considered income. If you look up the Employment appeals Tribunal website they outline clearly what is eligible for consideration.

    The Employment Appeals Tribunal states clearly about mitigating your financial loss and you should fully understand this when outlining your Case. For example if you are claiming a financial loss due to being out of work to the tune of €90k, they will ask you what you did to mitigate that loss. This means that you will have provide evidence that you were applying for jobs whilst you were not working. For sound legal advice contact Citizens advice bureau in regard to Employment Law. They will point you in the right direction.
