Business Liquidation Problem

    Hello all,

    We recently bought a house and got a local business to measure etc for tiles. We were asked for half upfront (as the tiles were being imported), which was fine. The owner also requested that the sum of money be paid to his wife's account - which we stupidly didn't question at the time - we trusted him. We feel he knew his business was going bust, but was hoping that it could be salvaged and by us putting the money into his wife's account, we were somehow 'safe'.

    The business went into liquidation - along with our money....however, as we had paid the money into his wife's account, did the bank have the right to take money from his wife's account to cover business debts?

    We really would rather sort this out without going into it legally, but having spoken to the bank - they are citing 'business fraud' etc - we are just wondering why we need to pay the price for the liquidation? Is it worth pursuing?

    Simple, sue the wife for the money so. The 'business' never got it, she did.

    Make sure you charge interest.

    Thanks Sponge Bob - If the bank took the money from her account and transferred it to the 'business liquidation', surely the business 'benefitted', by not having as many debts.
