State gave 100,000's euro to alone Downs Syndrome woman then ignored her

    Lena had Downs Syndrome and died recently. She lived in a care home till my mother met her brought her out for holidays. She lived with us for years till her uncle wanted someone to care for him for free as he got older and she wanted to live with relatives. Her cousin who lived in the UK helped her apply for the Redress Scheme but then told her it was a secret. Lena told me. This really annoyed her cousin.

    Her uncle told Lena to use the money to do up the house and he would leave it to her. She did but on his death he left it to his daughter. She was then harassed by her cousin who would walk around her room at night and sent her solicitors letters. Lena got a solicitor and sent solicitors letters back.

    How come the Redress Board did not put some Legal Trust in place for a woman with Downs Syndrome receiving hundreds of thousands of euro?
    Where was the HSE and social workers in all this?
    Will the cousin get away with this?

    This is a problem with the legal system in that courts can only award lump sum damages not continuing orders.

    A prudent person getting this should set up a trust for the person who is the subject of the award.

    Court orders are one off compensations not trusts.

    Should be changed IMO but there are legal hurdles

    Unfortunately you hear way too much of these stories. scumbag relations using the promise of an inheritance to take advantage of people only then to leave them high and dry.
