    Hi i have a 5 yr old with my exgirlfriend. I have legal gardianship.My daughter stays with me half the week i pay half for all her Clothes,child minder fee's extra activities etc.Am i legally bound to pay maintenance as well. Regards jonnster

    What does the courts say?

    I'm sorry buts its a kind of how long is a piece of string type question. Maintenance arrangements ary greatly from case to case and it depends on what the court has ordered or you have agreed with your ex.

    This is your child, you are the child's guardian, you have an agreement to maintain.

    Uphold your agreement, stay away from Courts and live up to your agreed terms.

    Has the childs mother applied for maintenance? Also, is there an access order in place or is the current arrangement on access also verbal? Without any facts i can say one thing with confidence, keep away from the courts at all costs (within reason).

    You may be, yes, especially if your earnings are higher than your ex's. But every case is different; for an answer tailored to your circumstances you really need legal advice.

    OP, I can give you my experience if it helps, seperated father of 3. Have my kids 3 nights one week and 4 nights the next.

    Ex looked for maintenance but the courts ruled that other than providing half of all bills for school, christmas, clothes and so forth I was fulfilling my responsibility and was not liable to make a payment. As I am on sw and getting 188 a week I would ve had to give up taking them if she got an award against me. If/when I do return to work the judge will review the circumstances.

    My only concern is that she gets the full QCA and I get nothing even tho we share custody
