Full time gyms and council tax

    Hi lads,
    Would Any of you guys out there who run a full time gym have any experiences with dealing with the council in relation to rates/taxes?

    Is there a way of becoming exempt? Etc

    Any info appreciated

    simple answer is NO john. not unless you want to become a charity then you wont have to pay it.

    I could stand to be corrected though.

    Cheers Paddy, IABA gyms are exempt so I was wondering if any other clubs had any success with it.

    A full list of the clubs that are tax exempt can be found on the link below-

    The criteria for exemption seems a bit vague-
    235.—(1) In this section, “approved body of persons” means—
    (a) any body of persons established for and existing for the sole purpose of promoting athletic or amateur games or sports, and
    (b) (i) any body of persons that, as respects the year 1983-84 or any earlier year of assessment, was granted exemption from income tax under section 349 of the Income Tax Act, 1967 , before that section was substituted by section 9 of the Finance Act, 1984 , or

    (ii) any company that, as respects any accounting period ending before the 6th day of April, 1984, was granted exemption from corporation tax under section 349 (before the substitution referred to in subparagraph (i)) of the Income Tax Act, 1967 , as applied for corporation tax by section 11 (6) of the Corporation Tax Act, 1976 ;


    You could give the tax office in Nenagh a shout to see if you qualify. IMAC Martial Arts Ireland Limited, Finglas Kempo and Bushido Martial Arts are on the list so there might be a chance.

    Revenue Commissioners,
    Government Offices,
    Nenagh,
    Co. Tipperary.

    Not sure if the exemption excludes you from paying council rates though, probably just income tax.

    That applies to exemptions from Income Tax/Corparation Tax/CGT etc. not commercial rates.

    Commercial rates are regulated by the Valuation Act (it may have been updated since last I looked at it though). Pretty much if you're making a profit or trying to, you have to pay your rates.

    Just checked that out, yeh it's tax exempt.

    I've been onto the local rates collector and picked up some useful info that might benefit others here.

    The rates bill i was handed 4,450 for last year was based on a valuation that was conducted in 2004, at the height of the boom. The lad across the way for me has a rates bill half that and he had his unit revalued recently. So that's where we're at at the moment.

    If your rates are huge there is a chance you're paying for an old valuation and it might be time to get a new one done.

    It is worth pointing out that valuations can go up as well as down so check with your neighbors before rushing off to get a revaluation. If in doubt any member of the public can go to their relevant County Council and ask to view their rates books.

    Also measure like with like, size of premises, rent paid, foot fall etc. An example of this is that a shop on Grafton Street is going to pay more Commercial Rates then a similar size unit in an Industrial Estate.


    It also costs 250 Euro to have your premises revalued by the Valuations Office.

    Hi Liam sorry about the confusion mate;

    Lads in case I caused a bit of confusion with my original post. I was just chatting to Liam there who I mentioned in my OP and he asked me just to clarify that that his BJJ club had nothing to do with my initial discussion with a friend of mine regarding council rates and the IABA, he just happened to train in the same place so I've edited the OP. Apologies to Liam for any confusion and for causing his phone to hop!
