Hit and Run.

Car was involved in a hit and run. Thankfully an eye witness saw the whole incident and took the culprits reg down.

He denies it down to the ground even though his car was blatantly damaged and just shrugs his shoulders when asked what happened. Pulled the same **** when the garda knocked down to question him.

About 3 weeks after the incident the cars were taking away for paint analysis. Just got the results back yesterday and it wasn't conclusive???

What happens now?? He is still denying it down to the ground??

The latest from the insurance was that they were waiting for the paint to match up and that should be the end of it? Obviously they haven't matched up, or they didn't find any traces on either car?

    What now???

The eye witness is willing to go to court.

So the eyewitness took down the reg and it matched up with a car that was the same make and model? If so then its obvious it was him.

I was in a similar situation before Christmas. I got the reg myself, gave it to the guards. It matched the car that I seen. The driver was even the person who I described, however, it turned out the car was registered as scrapped. So the guy was never held accountable.

I am in the process of claiming of the MIBI. You can still get your car fixed off your insurers and they are not allowed to remove your NCB.

If you do have any significant injurys then claiming of the MIBI is pretty much the same as claiming off any other insurer. I would recommend getting a solicitor if you do have to go that route though.

It's 100% him. Even the garda we have been dealing with says he knows for sure it was him. I have a solicitor already. It seemed fairly straight forward until these results came back. I was given the impression from an insurance guy that these were needed even with a witness??

Tbh I don't care about them being charged (even though they should be), I just want my car fixed and forget about the whole thing.

Well tell your insurer to fix your car.

If that guys insurance never pays out then you were hit by an uninsured driver in which case your insurance cant remove your NCB.

So either way your car will be fixed and you cant be at a loss for it.

btw I was the other way, I didn't give a crap about my car I just wanted the b*stard charged for what he done on me.

I dont think thats the case, is it? If the OP gets their insurance to pay out then they will have a claim against their policy. If their insurer is unsuccessful in recouping the money from the third parties insurer then the OP will continue to have a claim against their policy, along with the possible repercussions at renewal time.
