planning problems

    hey folks,

    A site recently came up for sale that im very interested in, my problem is

    the site originally had planning permission granted, the original owner built the house up to wall plate level, and then he ran into financal problems and the house has remained unfinished with 10 or so years,

    i went to the planning office to look at the plans, but the style of house on the plans isnt something im mad about, basically what im looking for info on is if i was to buy this site and try and change the plans, would i be looking at a whole new application and council fees, or is there another way to go about it

    It would be a new application... but I'm sure the planners would be happier to see a finished house (of similar style/size) on the site than a half finished building site! Go for a pre planning meeting and that will give you a good idea of what they will allow.

    Hey jap gt

    The best thing to do would be to seek outline planning permission - this will last for the period of three years and give you time then to move hope in the interim. It should be noted that if you wish to apply for a new design you may also require permission to demloish the existing structure.

    During the three year period that outline is in place you wil need to apply for full planning permission prior to the expiration on the outline. The full application then will give you 5 years to act.

    Are there any occupancy restrictions on the site? If there is a condition that the person who was granted planning must live in the house for a minimum period before selling you will have problems. There is usually an exception that allows the house to be sold if the person has run into financial difficulties but you would still have to build to the same plans.

    If you want to look for new planning you should only buy the site subject to planning permission being granted. Changes to the county development plan since the original planning was granted may mean that planning would not now be granted on that site.
