Bank Holiday Pay Part-Time

    Folks,
    This has probably been done 200 times on boards before but sure here we go again:

    I'm in college and working part-time in a late bar in Dublin City Center. I'm rostered to work next week Saturday and Sunday evening shifts. From having worked bank holidays before i think i'm entitled to some 'extra-pay' for working these days. Anyone know what the law here is?

    Paddy's Day is this Sunday but Ireland recognise the Monday as a bank holiday.

    When i'm working Saturday night (16th), should i be paid extra from midnight until 4am? Also my Sunday shift until close (monday 18th to 4am)?

    I asked one of the guys who's been there a while and he said part-time staff don't get paid extra for bank holidays???? As far as i remember this isn't legal?:confused:

    I've only worked there for 1 month now

    Any help would be great thanks :)

    First off Sunday 17th is in fact the public holiday. Monday is as you state a bank holiday but bank holidays are a different issue and only apply if you work in a bank! It is the public holiday that is relevant and this is the Sunday (some companies will chose to close on Monday 18th as a day in lieu but this is at their discretion. As long as they follow the rules and give a days leave within a month of the public holiday OR a days pay OR an extra day annual leave they are covered.)

    As far as pay goes, there is no law that says they must pay you extra. There is nothing illegal in that at all. There are a number of options available to employers as mentioned above. As a part timer the amount of pay/time off depends on the average hours you have built up in the 5 weeks preceding the public holiday.

    So i spoke to my boss about this and he said that the only day they pay 'extra' is today (18th march) and not for St Patrick's day. I went to the link you posted and it says:
    The list of public holidays each year is as follows:

    New Year's Day (1 January)
    St. Patrick's Day (17 March)
    Easter Monday
    First Monday in May, June, August
    Last Monday in October
    Christmas Day (25 December)
    St. Stephen's Day (26 December)

    If you work on one these days yo are entitled to:
    A paid day off on the public holiday
    An additional day of annual leave
    An additional day's pay (He said staff working monday the 18th get this, not the 17th??)
    A paid day off within a month of the public holiday

    ''If you have worked for your employer at least 40 hours in the 5 weeks before the public holiday and the public holiday falls on a day you normally work you are entitled to a day's pay for the public holiday. If you are required to work that day you are entitled to an additional day's pay.''

    I have worked for the company for 4 weeks and have done roughly 80 hours so far. It appears that the company should be paying their staff who worked Paddy's Day a day off, this is a bit confusing for me.

    Can anyone clarify the situation?
