car still not repaired - Do i need to pay again to fix the problem?

    Hi all i took a car to the north of Ireland to get fixed. It needed an a part fitted to the gearbox, the dash needed to be stripped for the fan to be rewired. I brought the car up to them on Tuesday 29th January 2013. They told me it would be ready on the Friday 1st February 2013 and cost £1000. On this information i said ok and expect to have the car back within the week as advised. They had to break a panel as they said the bolts were rung on the dash and so this might mean having to replace the air bag which would cost a further £600

    . It was 2 weeks in before i was contacted for this and when they got the panel off they told me that they did not need to break the airbag. it took a week for the air bag to arrive and then they told they need to break the airbag to get the new panel on.They said that there was so many hours logged on the car at this stage that i already owed £1000 and that the mechanics would not put the car back together without replacing the air bag due to safety so i really had no choice but to agree to it. So on the 28th February 2013 the car was finally ready.

    I turn up on a saturday and the bill is £1500. I paid the bill, and got in the car to drive home. The cigarette lighter shelf is jammed shut and i eventually shimmy it open. I quickly realise why and see that the cigarette lighter has not been fixed at all. I drive home anyway as i need the car for work and college and so i just drove home. I get home and look at the breakdown. There is nothing on the breakdown about the part for the gearbox.

    I ring them and they deny saying they would replace the part. The next day, the car stalls and wont go into gear and the same warning displays on the dash. So i ring again and demand to speak to a manager. She apologises for how I've been treated and advise that they will give it there immediate attention if i bring the car up to them for them to examine it again. However, she said she would need to look into the matter further and could not say at the time if i will have to pay for the part to be fitted which i am certain was included in the original quote i was given over a month ago.

    I don't have any recordings of the phone calls but i can get the records of the calls made to and received from the garage. Also i assume they would have to release the data they have for my car following a data request which they admitted that it states on that i told them the car was going into gear.

    So can i take any legal action if they insist further payment will be needed to fix the job?

    Sounds like you set yourself up for this Never drive a car away without checking the work is done correctly. Never pay a bill without checking it

    Madness would you believe there are mechanics south of the border too.

    Bottom line is of course you can take legal action
