What does this mean

    I appealed against a sanction as I had overwhelming evidence that it was incorrect..before I get my appeal (I was looking forward to it) ..they dropped the whole thing and granted it as they knew it was going to leave people with egg on their faces.

    The letter ends with this..what the hell does that mean?

    "While noting your grounds for appeal, it was granted on a matter of procedure"

    You can appeal on merits;

    I say you're working and you're actually not.

    Or

    Procedure;

    I should have sent a letter by Tuesday and I sent it Thursday.

    Think of it like a 'technicality' in law and order.

    Oh so, they are granting the appeal because they made a hash of the procedure and not because I can prove they were 100% wrong with their original decision subject to letting me have the appeal. Sounds like a cop out.

    Might be a perfectly good procedure, but just wasn't followed correctly. You want to be careful though. The law in Ireland allows a public body to be 99.9% wrong in a decision as long as the correct procedure was followed. As long as they have some basis, however weak, the courts will, theoretically, not interfere. I'm sure it's probably different in practice.

    You could always try and judicially review a decision in your favour, please let me know if you do - I'd love to see it happen :D

    well they are 100% wrong and the correct procedures were not followed, and were repeatedly pointed out to them. It took a solicitor to make them come out with this tripe, and not givin me the chance to not only have them on this technicality but on a few others, this along with the overwhelming evidence I was about to produce at the appeal. Lot's of questions remain unanswered and I still contemplate a civil legal action.

    That's great.

    Sometimes, mistakes are made, wrong advice is given, etc.

    We have a charter here for similar reasons. The dangers of incorrect advice are great.

    So it sounds like your complaint was procedural?

    BTW I'm not looking for specifics or trying to give advice with the exception of one or two I'm the last person you'd want advice from. I'm more facilitating your rant. It's good to get these things off one's chest.

    My advice (for what it's worth ;) ) a wins a win move on.

    It's not a win when the original incident i reported and the protection of the "golden boy" still remains unpunished when it was illegal as well as immoral

    I read it as OP stop whinging and Procrasta stop talking bollocks but then I don't understand Tom Young most of the time. He turns cryptic/interpretable comments into an art form.

    My remarks about advice were directed towards the State, or whomever it was incorrectly pursued a case against you.

    If they've consented to whatever your appeal point was - move on.

    See I'm wrong again. However +1 on the moving on. If you think it warrants public attention approach the press, after taking advice on defamation of course. I wish you all the best OP.
